SUPPLEMENTARY AGREEMENT 1 to the Agreement of 21 March 1955 on the establishment of through international railway tariffs

THE REPRESENTATIVES OF THE GOVERNMENTS OF THE MEMBER STATES OF THE EUROPEAN COAL AND STEEL COMMUNITY, MEETING IN COUNCIL;

Having regard to Article 70 of the Treaty of 18 April 1951 establishing the European Coal and Steel Community;

Pursuant to the provisions of the second paragraph, and of subparagraph (2) of the third paragraph, of Article 10 of the Convention on the Transitional Provisions, concerning the establishment of through international tariffs;

Having regard to the Agreement of 21 March 1955 on the establishment of through international railway tariffs;

HAVE AGREED AS FOLLOWS:

Article 1

A new paragraph worded as follows shall be added to paragraph 3 of Annex II to the Agreement of 21 March 1955 referred to above:

"Nevertheless until 30 April 1959 the limiting coefficient for distance charges in Italy shall not exceed the value of the Italian national coefficient for a distance of (a) 500 km from 1 May 1956 to 30 April 1958;

(b) 700 km from 1 May 1958 to 30 April 1959."

Article 2

An Annex III worded as follows shall be added to the Agreement of 21 March 1955 referred to above:

"ANNEX III

to the Agreement of 21 March 1955 on the establishment of through international railway tariffs

Consignments of coal and steel carried direct over connecting sections of the railways of two or more Member States: - from a third State to a Member State of the Community;

- from a Member State of the Community to a third State;

- from a third State to a third State through one or more Member States of the Community;

shall, in respect of their passage through Member States of the Community, have the benefit of the provisions of the Agreement."

Article 3

The text of this Supplementary Agreement, as recorded in the minutes of the proceedings of the Council shall be published in the Official Journal of the Community.

This Agreement shall enter into force on 1 May 1956. 1This Supplementary Agreement was concluded during the 31st Session of the Council, held on 16 March 1956.
