Publication of and access to information in Member States concerning interconnection in telecommunications

Article 14 of Directive 97/33/EC of the European Parliament and the Council of 30 June 1997 on interconnection in telecommunications with regard to ensuring universal service and interoperability through application of the principles of open network provision (ONP)(1) requires national regulatory authorities to ensure that the information identified in Article 7(3), Arcticle 9(2), Article 10 and Article 12(4) of the Directive (see tables below) is published in an appropriate manner in order to provide easy access for interested parties.
The information identified in Article 4(1), Article 5(3), Article 5(5), Article 6(c) and Article 9(3) of the Directive shall be made available on request to interested parties, free of charge, during normal working hours.
Reference shall be made in the national official gazette of the Member State concerned to the manner in which this information is published, including where appropriate the times and location(s) at which the information is available. The Commission shall regularly publish a corresponding reference in the Official Journal of the European Communities.
Article 18 of Directive 97/33/EC requires national regulatory authorities to notify to the Commission the names of those organisations which have universal service obligations, are subject to the provisions concerning organisations with significant market power, or are covered by Annex II of the Directive as having rights and obligations to negotiate interconnection with each other in order to ensure Community-wide services. The Commission shall publish these names in the Official Journal of the European Communities. There are three different groups of organisations with significant market power to whom specific provisions apply.
1. Organisations providing fixed public telephone networks and services and leased lines which have been notified by their NRA as having significant market power in these markets
These organisations have obligations in the following areas:
- access to the network (Article 4(2) of Directive 97/33/EC),
- non-discrimination and transparency (Article 6),
- transparency and cost orientation for interconnection charges (Article 7(2)),
- publication of reference interconnection offres (Article 7(3)),
- unbundling of interconnection charges, use of transparent cost accounting systems (Article 7(4) to (6)),
- accounting separation for interconnection activities and other activities (Article 8(2)).
2. Organisations providing public mobile telephone networks and services whiche have been notified by their NRA as having significant market power in these markets.
These organisations have obligations in the following areas:
- access to the network (Article 4(2) of Directive 97/33/EC),
- non-discrimination and transparency (Article 6).
3. Organisations providing public mobile telephone networks and services which have been notified by their NRA as having significant market power on the national market for interconnection.
These organisations have the obligation of transparency and cost orientation for interconnection charges (Article 7(2) of Directive 97/33/EC).
This publication fulfils the Commission's aforementioned obligations.
Since the information dealt with here may be subject to frequent changes, it is recommended to verify its validity by contacting the provider mentioned in the corresponding table. An increasing part of this information can also be found on the Internet.
This publication is without prejudice to any action the Commission may decide to initiate under Article 169 of the Treaty.
