COMMISSION OPINION

of 12 March 1999

concerning the plan for the disposal of radioactive waste from the operation of the Interim Storage North located in Mecklenburg-Vorpommern in the Federal Republic of Germany in accordance with Article 37 of the Euratom Treaty

On 15 September 1998, the European Commission received from the Government of the Federal Republic of Germany, in accordance with Article 37 of the Euratom Treaty, general data relating to the plan for disposal of radioactive waste resulting from the operation of the Interim Storage North (ZLN) in Mecklenburg-Vorpommern.

On the basis of these data and clarifications subsequently provided by the German Government, and following consultation with the group of experts, the Commission has drawn up the following opinion.

(a) The distance between the plant and the closest State border (with the Republic of Poland) is 45 km, the nearest territories of Member States being about 120 km (Denmark) and 135 km (Sweden).

(b) Under normal operating conditions, the discharges of liquid and gaseous effluents will not cause an exposure of the population in other Member States significant from the health point of view.

(c) Low and medium radioactive waste conditioned in the installation will be stored on site.

(d) In the event of unplanned discharges of radioactive waste which may follow an accident of the type and magnitude considered in the general data, the doses likely to be received by the population in other Member States would not be significant from the health point of view.

(e) The general data do not contain information with regard to a programme for radioactivity monitoring in the marine environment but it is understood that such monitoring is carried out in the Baltic Sea; the Commission recommends that this be part of the statutory federal requirements and that the results of such monitoring be made available to the Commission, to neighbouring Member States and to Poland.

In conclusion, the Commission is of the opinion that the implementation of the plan for the disposal of radioactive waste from the operation of the Interim Storage North, both in normal operation and in the event of an accident of the type and magnitude considered in the general data, is not liable to result in the radioactive contamination, significant from the point of view of health, of the water, soil or airspace of another Member State.
