COMMISSION REGULATION (EC) No 114/94 of 24 January 1994 amending Regulation (EEC) No 1756/93 fixing the operative events for the agricultural conversion rate applicable to milk and milk products

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Regulation (EEC) No 3813/92 of 28 December 1992 on the unit of account and the conversion rates to be applied for the purposes of the common agricultural policy (1), and in particular Article 6 (2) thereof,

Whereas the purpose of Commission Regulation (EEC) No 1756/93 (2), as amended by Regulation (EEC) No 2866/93 (3), is to fix the exact agricultural conversion rate applying to amounts fixed in ecus in the milk and milk products sector; whereas, to this end, the said Regulation must be supplemented by fixing the operative events for the amounts referred to in Article 4 (2) (c) of Commission Regulation (EEC) No 2839/93 of 18 October 1993 on the special sale of intervention butter for export to the Republics of the former Soviet Union (4), as last amended by Regulation (EC) No 109/94 (5);

Whereas Regulation (EEC) No 1756/93 does not specify the operative event for the agricultural conversion rate to be applied in respect of the aid granted for skimmed milk pursuant to Article 1 (1) (b) of Commission Regulation (EEC) No 1105/68 of 27 July 1968 on detailed rules for granting aid for skimmed milk for use as feed (6), as last amended by Regulation (EEC) No 1723/93 (7); whereas this should therefore be rectified;

Whereas Commission Regulation (EEC) No 2167/83 of 28 July 1983 laying down detailed rules for the supply of milk and certain milk products to schoolchildren (8), as last amended by Regulation (EEC) No 1861/93 (9), has been repealed and replaced by Regulation (EC) No 3392/93 (10); whereas the reference in the Annex to Regulation (EEC) No 1756/93 should accordingly be amended;

Whereas the Management Committee for Milk and Milk Products has not delivered an opinion within the time limit set up by its chairman,

HAS ADOPTED THIS REGULATION:

Article 1

Regulation (EEC) No 1756/93 is hereby amended as follows:

1. The following point 8 is added to part B. II of the Annex:

"" ID="1">'8. (EEC) No 2839/93> ID="2">Tender price accepted as part of the tenders referred to in Article 4 (2) (c)> ID="3">Agricultural conversion rate applicable on the date of payment'">

2. Point 1 of part C. III of the Annex is replaced by the following:

"" ID="1">'1. (EEC) No 1105/68> ID="2">A. Amount of aid for skimmed milk for use in feedingstuffs referred to in Article 1> ID="3">Agricultural conversion rate applicable on : (i) the first day of the month in which the skimmed milk referred to in Article 2 is denatured or in which skimmed milk is delivered to the farmer (ii) the first day of the month for which the monthly statement is drawn up in respect of the use of skimmed milk pursuant to Article 5a (iii) the first day of the month in which butter or cream is produced for skimmed milk used pursuant to Articles 6 and 8a"> ID="2">B. Amount of aid for skimmed milk for use in feedingstuffs referred to in Article 1a (3)> ID="3">Agricultural conversion rate applicable on the first day of the month in which the skimmed milk referred to in Article 2 is denatured or in which the liquid skimmed milk is delivered to the farmer'">

3. Point 4 of the part D of the Annex is replaced by the following:

"" ID="1">'4. (EEC) No 3392/93> ID="2">Amount of aid for school milk referred to in Article 4 (1)> ID="3">Agricultural conversion rate applicable on the first day of the month of the period for which the aid application referred to in Article 7 (4) is submitted'">

Article 2

This Regulation shall enter into force on the seventh day following its publication in the Official Journal of the European Communities. However, Article 1 (3) shall apply with effect from 1 January 1994.This Regulation shall be binding in its entirety and directly applicable in all Member States.Done at Brussels, 24 January 1994.
