DECISION No 137 of 15 December 1988 concerning the application of Article 15 (3) of Regulation (EEC) No 574/72 (89/C 140/03)

THE ADMINISTRATIVE COMMISSION OF THE EUROPEAN COMMUNITIES ON SOCIAL SECURITY FOR MIGRANT WORKERS,

Having regard to Article 81 (a) of Council Regulation (EEC) No 1408/71 of 14 June 1971 on the application of social security schemes to employed persons, self-employed persons, and members of their families moving within the Community (1), under which it is made responsible for dealing with all administrative questions and questions of interpretation arising from Regulation (EEC) No 1408/71 and subsequent regulations,

Whereas for the purposes of aggregation Article 15 (3) of Regulation (EEC) No 574/72 (2) lists the conversion rules to be adhered to, where appropriate, when periods of insurance completed under the legislation of a Member State are expressed in units different from those used by the legislation of another Member State;

Whereas it is clear from the system of equivalence of units provided for in Article 15 (3) of Regulation (EEC) No 574/72 that the institution carrying out the conversion must take account of the data as transmitted to it;

Whereas it is necessary to specify how the data on which conversion is based must be used,

HAS DECIDED AS FOLLOWS:

1. The period of insurance to be used as the basis for the conversion provided for by Article 15 (3) of Regulation (EEC) No 574/72 shall be that communicated by the institution of the Member State under whose legislation the said period was completed.

2. This means that the conversion shall be carried out - either in one single operation covering all the periods, if these periods were communicated as an aggregate,

- or for each year, if the periods were communicated on a year-by-year basis.

3. This Decision shall be published in the Official Journal of the European Communities. It shall be applicable from the first day of the month following its publication.
