Decision of the EEA Joint Committee

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex I to the Agreement was amended by Decision of the EEA Joint Committee No 69/2004 of 8 June 2004 [1]

(2) Council Directive 2003/43/EC of 26 May 2003 amending Directive 88/407/EEC laying down the animal health requirements applicable to intra-Community trade in and imports of semen of domestic animals of the bovine species [2] is to be incorporated into the Agreement.

(3) Commission Decision 2003/467/EC of 23 June 2003 establishing the official tuberculosis, brucellosis, and enzootic-bovine-leukosis-free status of certain Member States and regions of Member States as regards bovine herds [3] is to be incorporated into the Agreement.

(4) Council Directive 2003/50/EC of 11 June 2003 amending Directive 91/68/EEC as regards reinforcement of controls on movements of ovine and caprine animals [4] is to be incorporated into the Agreement.

(5) Commission Decision 2003/575/EC of 1 August 2003 amending Decision 2001/618/EC to include certain departments of France and a Province in Italy in the lists of Member States and regions free of Aujeszky's disease and regions where approved Aujeszky's disease eradication programmes are in place [5] is to be incorporated into the Agreement.

(6) Commission Regulation (EC) No 1398/2003 of 5 August 2003 amending Annex A to Council Directive 92/65/EEC to include the small hive beetle (Aethina tumida), the Tropilaelaps mite (Tropilaelaps spp.), Ebola and monkey pox [6] is to be incorporated into the Agreement.

(7) Commission Decision 2003/644/EC of 8 September 2003 establishing additional guarantees regarding salmonella for consignments to Finland and Sweden of breeding poultry and day-old chicks for introduction into flocks of breeding poultry or flocks of productive poultry [7] is to be incorporated into the Agreement.

(8) Commission Decision 2003/708/EC of 7 October 2003 amending Annex E to Council Directive 91/68/EEC and Annexes I and II to Decision 93/198/EEC as regards the updating of the model health certificates relating to ovine and caprine animals [8] is to be incorporated into the Agreement.

(9) Commission Decision 2003/732/EC of 10 October 2003 amending Decision 93/52/EEC as regards the recognition of certain Italian provinces as officially free of brucellosis [9] is to be incorporated into the Agreement.

(10) Decision 2003/644/EC repeals Commission Decision 95/160/EC [10], which is incorporated into the Agreement and which is consequently to be deleted from the Agreement.

(11) Decision 2003/467/EC repeals Commission Decisions 1999/465/EC [11], 1999/466/EC [12] and 1999/467/EC [13], which are incorporated into the Agreement and which are consequently to be deleted from the Agreement.

(12) This Decision is not to apply to Iceland and Liechtenstein,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter I of Annex I to the Agreement shall be amended as specified in the Annex to this Decision.

Article 2

The texts of Directives 2003/43/EC and 2003/50/EC, Regulation (EC) No 1398/2003 and Decisions 2003/467/EC, 2003/575/EC, 2003/644/EC, 2003/708/EC and 2003/732/EC in the Norwegian language, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 10 July 2004, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee [14].

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
