Decision of the EEA Joint Committee

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 174/2003 of 5 December 2003(1).

(2) Commission Directive 2003/70/EC of 17 July 2003 amending Council Directive 91/414/EEC to include mecoprop, mecoprop-P and propiconazole as active substances(2) is to be incorporated into the Agreement.

(3) Commission Decision 2003/565/EC of 25 July 2003 extending the time period provided for in Article 8(2) of Council Directive 91/414/EEC(3) is to be incorporated into the Agreement.

(4) Commission Directive 2003/79/EC of 13 August 2003 amending Council Directive 91/414/EEC to include Coniothyrium minitans as active substance(4) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

The following indents shall be added in point 12a (Council Directive 91/414/EEC) of Chapter XV of Annex II to the Agreement:

"- 32003 L 0070: Commission Directive 2003/70/EC of 17 July 2003 (OJ L 184, 23.7.2003, p. 9),

- 32003 D 0565: Commission Decision 2003/565/EC of 25 July 2003 (OJ L 192, 31.7.2003, p. 40),

- 32003 L 0079: Commission Directive 2003/79/EC of 13 August 2003 (OJ L 205, 14.8.2003, p. 16)."

Article 2

The texts of Directives 2003/70/EC and 2003/79/EC and Decision 2003/565/EC, in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 7 February 2004, provided that all the notifications pursuant to Article 103(1) of the Agreement have been made to the EEA Joint Committee(5).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
