amending Annex IX (Financial services) and Annex XXII (Company law) and to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex IX to the Agreement was amended by Decision of the EEA Joint Committee No 115/2003 of 26 September 2003(1).

(2) Annex XXII to the Agreement was amended by Decision of the EEA Joint Committee No 162/2003 of 7 November 2003(2).

(3) Directive 2003/51/EC of the European Parliament and of the Council of 18 June 2003 amending Directives 78/660/EEC, 83/349/EEC, 86/635/EEC and 91/674/EEC on the annual and consolidated accounts of certain types of companies, banks and other financial institutions and insurance undertakings(3) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

1. Annex IX to the Agreement is amended as follows:

(a) The following is added in point 12b (Council Directive 91/674/EEC):

", as amended by:

- 32003 L 0051: Directive 2003/51/EC of the European Parliament and of the Council of 18 June 2003 (OJ L 178, 17.7.2003, p. 16)."

(b) The following indent is added in point 21 (Council Directive 86/635/EEC):

"- 32003 L 0051: Directive 2003/51/EC of the European Parliament and of the Council of 18 June 2003 (OJ L 178, 17.7.2003, p. 16)."

2. Annex XXII to the Agreement is amended as follows:

(a) The following indent is added in point 4 (Council Directive 78/660/EEC) and in point 6 (Council Directive 83/349/EEC):

"- 32003 L 0051: Directive 2003/51/EC of the European Parliament and of the Council of 18 June 2003 (OJ L 178, 17.7.2003, p. 16)."

(b) The following is added in the second indent (Council Directive 83/349/EEC) in point 4 (Council Directive 78/660/EEC):

", as amended by:

- 32003 L 0051: Directive 2003/51/EC of the European Parliament and of the Council of 18 June 2003 (OJ L 178, 17.7.2003, p. 16)."

Article 2

The texts of Directive 2003/51/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 6 December 2003, provided that all the notifications pursuant to Article 103(1) of the Agreement have been made to the EEA Joint Committee(4).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
