amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex I to the Agreement was amended by Decision of the EEA Joint Committee No 140/2003 of 7 November 2003(1).

(2) Council Directive 2002/99/EC of 16 December 2002 laying down the animal health rules governing the production, processing, distribution and introduction of products of animal origin for human consumption(2) is to be incorporated into the Agreement.

(3) The animal heath rules laid down by Council Directives 72/461/EEC(3), 80/215/EEC(4), 91/494/EEC(5), 91/495/EEC(6), 92/45/EEC(7), 92/46/EEC(8) and 94/65/EC(9), which are incorporated into the Agreement, shall no longer apply as from 1 January 2005.

(4) This Decision is not to apply to Iceland and Liechtenstein,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter I of Annex I to the Agreement is amended as follows:

1. The following is inserted after point 6 (Council Directive 92/45/EEC) in Part 5.1:

"Products of animal origin for human consumption

6a. 32002 L 0099: Council Directive 2002/99/EC of 16 December 2002 laying down the animal health rules governing the production, processing, distribution and introduction of products of animal origin for human consumption (OJ L 18, 23.1.2003, p. 11)."

2. The heading "Products of other animals" before point 7 (Council Directive 92/118/EEC) in Part 5.1 is deleted and replaced by the following:

"Other products of animal origin"

3. The following indent is added in points 1 (Council Directive 72/461/EEC), 2 (Council Directive 91/494/EEC), 3 (Council Directive 80/215/EEC), 4 (Council Directive 92/46/EEC), 5 (Council Directive 91/495/EEC) and 6 (Council Directive 92/45/EEC) in Part 5.1:

"- 32002 L 0099: Council Directive 2002/99/EC of 16 December 2002 (OJ L 18, 23.1.2003, p. 11)."

4. The following is added in point 6 (Council Directive 94/65/EC) in Part 6.1:

", as amended by:

- 32002 L 0099: Council Directive 2002/99/EC of 16 December 2002 (OJ L 18, 23.1.2003, p. 11)."

5. The following indent is added in points 11 (Council Directive 92/46/EEC), 13 (Council Directive 91/495/EEC) and 14 (Council Directive 92/45/EEC) in Part 6.1:

"- 32002 L 0099: Council Directive 2002/99/EC of 16 December 2002 (OJ L 18, 23.1.2003, p. 11)."

6. The following is added in point 10 (Council Directive 94/65/EC) in Part 8.1:

", as amended by:

- 32002 L 0099: Council Directive 2002/99/EC of 16 December 2002 (OJ L 18, 23.1.2003, p. 11)."

7. The following indent is added in points 9 (Council Directive 91/494/EEC), 13 (Council Directive 92/46/EEC) and 14 (Council Directive 92/45/EEC) in Part 8.1:

"- 32002 L 0099: Council Directive 2002/99/EC of 16 December 2002 (OJ L 18, 23.1.2003, p. 11)."

Article 2

The text of Directive 2002/99/EC in the Norwegian language, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 6 December 2003, provided that all the notifications in accordance with Article 103(1) of the Agreement have been made to the EEA Joint Committee(10).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
