amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex I to the Agreement was amended by Decision of the EEA Joint Committee No 102/2003 of 26 September 2003(1).

(2) Commission Decision 2003/11/EC of 10 January 2003 amending Council Directive 85/511/EEC as regards the lists of laboratories authorised to handle live foot-and-mouth disease virus(2) is to be incorporated into the Agreement.

(3) Commission Decision 2003/135/EC of 27 February 2003 on the approval of the plans for the eradication of classical swine fever and the emergency vaccination of feral pigs against classical swine fever in Germany, in the federal States of Lower Saxony, North Rhine-Westphalia, Rhineland-Palatinate and Saarland(3) is to be incorporated into the Agreement.

(4) Commission Decision 2003/136/EC of 27 February 2003 on the approval of the plans for the eradication of classical swine fever in feral pigs and emergency vaccination of feral pigs against classical swine fever in Luxembourg(4) is to be incorporated into the Agreement.

(5) Commission Decision 2003/218/EC of 27 March 2003 on protection and surveillance zones in relation to bluetongue, and on rules applicable to movements of animals in and from those zones and repealing Decision 2001/783/EC(5) is to be incorporated into the Agreement.

(6) Decision 2003/135/EC repeals Commission Decisions 1999/39/EC(6), 1999/335/EC(7), 2000/281/EC(8) and 2002/161/EC(9), which are incorporated into the Agreement and which are consequently to be deleted from the Agreement.

(7) Decision 2003/136/EC repeals Commission Decision 2002/181/EC(10), which is incorporated into the Agreement and which is consequently to be deleted from the Agreement.

(8) Decision 2003/218/EC repeals Commission Decision 2001/783/EC(11), which is incorporated into the Agreement and which is consequently to be deleted from the Agreement.

(9) This Decision is not to apply to Iceland and Liechtenstein,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter I of Annex I to the Agreement is amended as follows:

1. the following indent is added in point 1 (Council Directive 85/511/EEC) in Part 3.1:

"- 32003 D 0011: Commission Decision 2003/11/EC of 10 January 2003 (OJ L 7, 11.1.2003, p. 82).";

2. the following point is inserted after point 26 (Commission Decision 2002/975/EC) in part 3.2:

"27. 32003 D 0218: Commission Decision 2003/218/EC of 27 March 2003 on protection and surveillance zones in relation to bluetongue, and on rules applicable to movements of animals in and from those zones and repealing Decision 2001/783/EC (OJ L 82, 29.3.2003, p. 35).";

3. the text of point 22 (Commission Decision 2001/783/EC) in part 3.2 is deleted;

4. under the heading "ACTS OF WHICH THE EFTA STATES AND THE EFTA SURVEILLANCE AUTHORITY SHALL TAKE DUE ACCOUNT" in part 3.2, the following points are inserted after point 19 (Commission Decision 2002/626/EC):

"20. 32003 D 0135: Commission Decision 2003/135/EC of 27 February 2003 on the approval of the plans for the eradication of classical swine fever and the emergency vaccination of feral pigs against classical swine fever in Germany, in the federal States of Lower Saxony, North Rhine-Westphalia, Rhineland-Palatinate and Saarland (OJ L 53, 28.2.2003, p. 47).

21. 32003 D 0136: Commission Decision 2003/136/EC of 27 February 2003 on the approval of the plans for the eradication of classical swine fever in feral pigs and emergency vaccination of feral pigs against classical swine fever in Luxembourg (OJ L 53, 28.2.2003, p. 52).";

5. under the heading "ACTS OF WHICH THE EFTA STATES AND THE EFTA SURVEILLANCE AUTHORITY SHALL TAKE DUE ACCOUNT" in part 3.2, the text of points 8 (Commission Decision 1999/39/EC), 10 (Commission Decision 1999/335/EC), 11 (Commission Decision 2000/281/EC), 15 (Commission Decision 2002/161/EC) and 16 (Commission Decision 2002/181/EC) are deleted.

Article 2

The texts of Decisions 2003/11/EC, 2003/135/EC, 2003/136/EC and 2003/218/EC in the Norwegian language, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 8 November 2003, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(12).

Article 4

This Decision shall be published in the EEA section of, and in the EEA Supplement to, the Official Journal of the European Union.
