amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 32/2003 of 14 March 2003(1).

(2) Directive 2002/45/EC of the European Parliament and of the Council of 25 June 2002 amending for the 20th time Council Directive 76/769/EEC relating to restrictions on the marketing and use of certain dangerous substances and preparations (short-chain chlorinated paraffins)(2) is to be incorporated into the Agreement.

(3) Commission Recommendation 2002/575/EC of 4 July 2002 on the results of the risk-evaluation and the risk-reduction strategies for the substances: o-anisidine, 1,4-dioxane(3) is to be incorporated into the Agreement.

(4) Commission Recommendation 2002/576/EC of 4 July 2002 on the results of the risk evaluation for the substances: ethyl acetoacetate, 4-Chloro-o-cresol, Dimethyldioctadecylammonium chloride(4) is to be incorporated into the Agreement.

(5) Commission Directive 2002/62/EC of 9 July 2002 adapting to technical progress for the ninth time Annex I to Council Directive 76/769/EEC on the approximation of the laws, regulations and administrative provisions of the Member States relating to restrictions on the marketing and use of certain dangerous substances and preparations (organostannic compounds)(5), as corrected in OJ L 203, 1.8.2002, p. 64, is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter XV of Annex II to the Agreement shall be amended as follows:

1. the following indents shall be added in point 4 (Council Directive 76/769/EEC): "- 32002 L 0045: Directive 2002/45/EC of the European Parliament and of the Council of 25 June 2002 (OJ L 177, 6.7.2002, p. 21),

- 32002 L 0062: Commission Directive 2002/62/EC of 9 July 2002 (OJ L 183, 12.7.2002, p. 58), as corrected in OJ L 203, 1.8.2002, p. 64.";

2. under the heading "acts of which the contracting parties shall take note", the following points shall be inserted after point 22 (Commission Recommendation 2002/755/EC):

"23. 32002 H 0575: Commission Recommendation 2002/575/EC of 4 July 2002 on the results of the risk evaluation and the risk reduction strategies for the substances: o-anisidine, 1,4-dioxane (OJ L 181, 11.7.2002, p. 29).

24. 32002 H 0576: Commission Recommendation 2002/576/EC of 4 July 2002 on the results of the risk evaluation for the substances: ethyl acetoacetate, 4-Chloro-o-cresol, Dimethyldioctadecylammonium chloride (OJ L 181, 11.7.2002, p. 35)."

Article 2

The texts of Directives 2002/45/EC and 2002/62/EC, as corrected in OJ L 203, 1.8.2002, p. 64, and Recommendations 2002/575/EC and 2002/576/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 21 June 2003, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(6).

Article 4

This Decision shall be published in the EEA section of, and in the EEA Supplement to, the Official Journal of the European Union.
