amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex I to the Agreement was amended by Decision of the EEA Joint Committee No 39/2003 of 16 May 2003(1).

(2) Council Regulation (EC) No 1756/2002 of 23 September 2002 amending Directive 70/524/EEC concerning additives in feedingstuffs as regards withdrawal of the authorisation of an additive and amending Commission Regulation (EC) No 2430/1999(2) is to be incorporated into the Agreement.

(3) Commission Regulation (EC) No 1876/2002 of 21 October 2002 concerning the provisional authorisation of a new use of an additive in feedingstuffs(3) is to be incorporated into the Agreement.

(4) Commission Regulation (EC) No 2188/2002 of 9 December 2002 concerning the provisional authorisation of new uses of additives in feedingstuffs(4) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter II of Annex I to the Agreement shall be amended as follows:

1. The following indent shall be added in point 1 (Council Directive 70/524/EEC):

"- 32002 R 1756: Council Regulation (EC) No 1756/2002 of 23 September 2002 (OJ L 265, 3.10.2002, p. 1)."

2. The following shall be added in point 1k (Commission Regulation (EC) No 2430/1999):

", as amended by:

- 32002 R 1756: Council Regulation (EC) No 1756/2002 of 23 September 2002 (OJ L 265, 3.10.2002, p. 1)."

3. The following points shall be inserted after point 33 (Directive 2002/32/EC of the European Parliament and of the Council):

"34. 32002 R 1876: Commission Regulation (EC) No 1876/2002 of 21 October 2002 concerning the provisional authorisation of a new use of an additive in feedingstuffs (OJ L 284, 22.10.2002, p. 7).

35. 32002 R 2188: Commission Regulation (EC) No 2188/2002 of 9 December 2002 concerning the provisional authorisation of new uses of additives in feedingstuffs (OJ L 333, 10.12.2002, p. 5)."

Article 2

The texts of Regulations (EC) Nos 1756/2002, 1876/2002 and 2188/2002 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 21 June 2003, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(5).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
