amending Annex XIII (Transport) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex XIII to the Agreement was amended by Decision of the EEA Joint Committee No 36/2003 of 14 March 2003(1).

(2) Commission Decision 2002/885/EC of 7 November 2002 amending Council Directive 96/49/EC as regards the time-limits within which pressure drums, cylinder racks and tanks for the transport of dangerous goods by rail must comply with it(2) is to be incorporated into the Agreement.

(3) Commission Decision 2002/886/EC of 7 November 2002 amending Council Directive 94/55/EC as regards the time-limits within which pressure drums, cylinder racks and tanks for the transport of dangerous goods by road must comply with it(3) is to be incorporated into the Agreement.

HAS DECIDED AS FOLLOWS:

Article 1

Annex XIII to the Agreement shall be amended as follows:

1. The following indent shall be added in point 42b (Council Directive 96/49/EC):

"- 32002 D 0885: Commission Decision 2002/885/EC (OJ L 308, 9.11.2002, p. 44)."

2. The following indent shall be added in point 17e (Council Directive 94/55/EC):

"- 32002 D 0886: Commission Decision 2002/886/EC of 7 November 2002 (OJ L 308, 9.11.2002, p. 45)."

Article 2

The texts of Decisions 2002/885/EC and 2002/886/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 17 May 2003, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(4).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
