No 47/2003

of 16 May 2003

amending Annex IX (Financial services) and Annex XIX (Consumer protection) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex IX to the Agreement was amended by Decision of the EEA Joint Committee No 167/2002 of 6 December 2002(1).

(2) Annex XIX to the Agreement was amended by Decision of the EEA Joint Committee No 160/2001 of 18 January 2002(2).

(3) Directive 2002/65/EC of the European Parliament and of the Council of 23 September 2002 concerning the distance marketing of consumer financial services and amending Council Directive 90/619/EEC and Directives 97/7/EC and 98/27/EC(3) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

1. Annex IX to the Agreement shall be amended as follows:

(a) The following shall be inserted after point 30c (Directive 97/9/EC of the European Parliament and of the Council):

"IV. PROVISIONS APPLYING TO ALL KINDS OF FINANCIAL SERVICES

30d. 32002 L 0065: Directive 2002/65/EC of the European Parliament and of the Council of 23 September 2002 concerning the distance marketing of consumer financial services and amending Council Directive 90/619/EEC and Directives 97/7/EC and 98/27/EC (OJ L 271, 9.10.2002, p. 16)."

(b) The following shall be added in the first indent (Second Council Directive 90/619/EEC) of point 11 (First Council Directive 79/267/EEC):

", as amended by:

- 32002 L 0065: Directive 2002/65/EC of the European Parliament and of the Council (OJ L 271, 9.10.2002, p. 16)."

2. Annex XIX to the Agreement shall be amended as follows:

(a) The following shall be added in point 3a (Directive 97/7/EC of the European Parliament and of the Council):

", as amended by:

- 32002 L 0065: Directive 2002/65/EC of the European Parliament and of the Council (OJ L 271, 9.10.2002, p. 16)."

(b) The following indent shall be added in point 7d (Directive 98/27/EC of the European Parliament and of the Council):

"- 32002 L 0065: Directive 2002/65/EC of the European Parliament and of the Council (OJ L 271, 9.10.2002, p. 16)."

Article 2

The texts of Directive 2002/65/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 17 May 2003, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(4).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
