amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 6/2003 of 31 January 2003(1).

(2) Commission Directive 2002/69/EC of 26 July 2002 laying down the sampling methods and the methods of analysis for the official control of dioxins and the determination of dioxin-like PCBs in foodstuffs(2), is to be incorporated into the Agreement.

(3) Commission Decision 2002/678/EC of 22 August 2002 amending Decision 2002/79/EC imposing special conditions on the import of peanuts and certain products derived from peanuts originating in or consigned from China(3) is to be incorporated into the Agreement.

(4) Commission Decision 2002/679/EC of 22 August 2002 amending Decision 2002/80/EC imposing special conditions on the import of figs, hazelnuts and pistachios and certain products derived thereof originating in or consigned from Turkey(4) is to be incorporated into the Agreement.

(5) Commission Directive 2002/76/EC of 6 September 2002 amending the Annexes to Council Directives 86/362/EEC and 90/642/EEC as regards the fixing of maximum levels for pesticide residues (metsulfuron methyl) in and on cereals and certain products of plant origin, including fruit and vegetables(5) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter XII of Annex II to the Agreement shall be amended as follows:

1. The following indent shall be added in points 38 (Council Directive 86/362/EEC) and 54 (Council Directive 90/642/EEC):

"- 32002 L 0076: Commission Directive 2002/76/EC (OJ L 240, 7.9.2002, p. 45)."

2. The following indent shall be added in point 54zv (Commission Decision 2002/79/EC):

"- 32002 D 0678: Commission Decision 2002/678/EC (OJ L 229, 27.8.2002, p. 33)."

3. The following indent shall be added in point 54zw (Commission Decision 2002/80/EC):

"- 32002 D 0679: Commission Decision 2002/679/EC (OJ L 229, 27.8.2002, p. 37)."

4. The following point shall be inserted after point 54zzb (Commission Directive 2002/72/EC):

"54zzc. 32002 L 0069: Commission Directive 2002/69/EC of 26 July 2002 laying down the sampling methods and the methods of analysis for the official control of dioxins and the determination of dioxin-like PCBs in foodstuffs (OJ L 209, 6.8.2002, p. 5), as corrected by OJ L 252, 20.9.2002, p. 40."

Article 2

The texts of Directives 2002/69/EC and 2002/76/EC and Decisions 2002/678/EC and 2002/679/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 17 May 2003, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(6).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
