amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 159/2002 of 6 December 2002(1).

(2) Commission Directive 2002/41/EC of 17 May 2002 adapting to technical progress Directive 95/1/EC of the European Parliament and of the Council on the maximum design speed, maximum torque and maximum net engine power of two- or three-wheel motor vehicles(2) is to be incorporated into the Agreement.

(3) Commission Directive 2002/78/EC of 1 October 2002 adapting to technical progress Council Directive 71/320/EEC on the approximation of the laws of the Member States relating to the braking devices of certain categories of motor vehicles and their trailers(3) is to be incorporated into the Agreement.

(4) Commission Directive 2002/80/EC of 3 October 2002 adapting to technical progress Council Directive 70/220/EEC relating to measures to be taken against air pollution by emissions from motor vehicles(4) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter I of Annex II to the Agreement shall be amended as follows:

1. The following indent shall be added in point 3 (Council Directive 70/220/EEC):

"- 32002 L 0080: Commission Directive 2002/80/EC (OJ L 291, 28.10.2002, p. 20)."

2. The following indent shall be added in point 10 (Council Directive 71/320/EEC):

"- 32002 L 0078: Commission Directive 2002/78/EC (OJ L 267, 4.10.2002, p. 23)."

3. The following shall be added in point 45s (Directive 95/1/EC of the European Parliament and of the Council):

", as amended by:

- 32002 L 0041: Commission Directive 2002/41/EC (OJ L 133, 18.5.2002, p. 17)."

Article 2

The texts of Directives 2002/41/EC, 2002/78/EC and 2002/80/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 17 May 2003, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(5).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
