amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex I to the Agreement was amended by Decision of the EEA Joint Committee No 3/2003 of 31 January 2003(1).

(2) Council Directive 2002/53/EC of 13 June 2002 on the common catalogue of varieties of agricultural plant species(2) is to be incorporated into the Agreement.

(3) Council Directive 2002/54/EC of 13 June 2002 on the marketing of beet seed(3) is to be incorporated into the Agreement.

(4) Council Directive 2002/55/EC of 13 June 2002 on the marketing of vegetable seed(4) is to be incorporated into the Agreement.

(5) Council Directive 2002/57/EC of 13 June 2002 on the marketing of seed of oil and fibre plants(5) is to be incorporated into the Agreement.

(6) Council Directive 2002/68/EC of 19 July 2002 amending Directive 2002/57/EC on the marketing of seed of oil and fibre plants(6) is to be incorporated into the Agreement.

(7) Commission Decision 2002/756/EC of 16 September 2002 setting out the arrangements for Community comparative trials and tests on seeds and propagating material of certain plants under Council Directives 66/401/EEC, 66/402/EEC, 68/193/EEC, 92/33/EEC, 2002/54/EC, 2002/55/EC, 2002/56/EC and 2002/57/EC(7) is to be incorporated into the Agreement.

(8) Directive 2002/53/EC repeals Council Directive 70/457/EEC(8), which is incorporated into the Agreement and which is consequently to be deleted from the Agreement.

(9) Directive 2002/54/EC repeals Council Directive 66/400/EEC(9), which is incorporated into the Agreement and which is consequently to be deleted from the Agreement.

(10) Directive 2002/55/EC repeals Council Directive 70/458/EEC(10), which is incorporated into the Agreement and which is consequently to be deleted from the Agreement.

(11) Directive 2002/57/EC repeals Council Directive 69/208/EEC(11), which is incorporated into the Agreement and which is consequently to be deleted from the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter III of Annex I to the Agreement shall be amended as follows:

1. The following points shall be inserted after point 9 (Commission Directive 74/268/EEC) in part 1:

"10. 32002 L 0053: Council Directive 2002/53/EC of 13 June 2002 on the common catalogue of varieties of agricultural plant species (OJ L 193, 20.7.2002, p. 1).

The provisions of the Directive shall, for the purposes of the present Agreement, be read with the following adaptation:

References to other acts in the Directive shall be considered relevant to the extent and in the form that those acts are incorporated into the Agreement.

11. 32002 L 0054: Council Directive 2002/54/EC of 13 June 2002 on the marketing of beet seed (OJ L 193, 20.7.2002, p. 12).

The provisions of the Directive shall, for the purposes of the present Agreement, be read with the following adaptation:

References to other acts in the Directive shall be considered relevant to the extent and in the form that those acts are incorporated into the Agreement.

12. 32002 L 0055: Council Directive 2002/55/EC of 13 June 2002 on the marketing of vegetable seed (OJ L 193, 20.7.2002, p. 33).

The provisions of the Directive shall, for the purposes of the present Agreement, be read with the following adaptation:

References to other acts in the Directive shall be considered relevant to the extent and in the form that those acts are incorporated into the Agreement.

13. 32002 L 0057: Council Directive 2002/57/EC of 13 June 2002 on the marketing of seed of oil and fibre plants (OJ L 193, 20.7.2002, p. 74), as amended by:

- 32002 L 0068: Council Directive 2002/68/EC (OJ L 195, 24.7.2002, p. 32).

The provisions of the Directive shall, for the purposes of the present Agreement, be read with the following adaptation:

References to other acts in the Directive shall be considered relevant to the extent and in the form that those acts are incorporated into the Agreement."

2. The text of points 1 (Council Directive 66/400/EEC), 4 (Council Directive 69/208/EEC), 5 (Council Directive 70/457/EEC) and 6 (Council Directive 70/458/EEC) in part 1 shall be deleted.

3. The following point shall be inserted after point 20 (Commission Decision 2002/454/EC) in part 2:

"21. 32002 D 0756: Commission Decision 2002/756/EC of 16 September 2002 setting out the arrangements for Community comparative trials and tests on seeds and propagating material of certain plants under Council Directives 66/401/EEC, 66/402/EEC, 68/193/EEC, 92/33/EEC, 2002/54/EC, 2002/55/EC, 2002/56/EC and 2002/57/EC (OJ L 252, 20.9.2002, p. 33).

The provisions of the Decision shall, for the purposes of the present Agreement, be read with the following adaptation:

References to other acts in the Decision shall be considered relevant to the extent and in the form that those acts are incorporated into the Agreement."

Article 2

The texts of Directives 2002/53/EC, 2002/54/EC 2002/55/EC, 2002/57/EC and 2002/68/EC and Decision 2002/756/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 17 May 2003, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(12).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
