amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 139/2002 of 8 November 2002(1).

(2) Commission Regulation (EC) No 472/2002 of 12 March 2002 amending Regulation (EC) No 466/2001 setting maximum levels for certain contaminants in foodstuffs(2) is to be incorporated into the Agreement.

(3) Commission Regulation (EC) No 473/2002 of 15 March 2002 amending Annexes I, II and VI to Council Regulation (EEC) No 2092/91 on organic production of agricultural products and indications referring thereto on agricultural products and foodstuffs, and laying down detailed rules as regards the transmission of information on the use of copper compounds(3) is to be incorporated into the Agreement.

(4) Commission Directive 2002/26/EC of 13 March 2002 laying down the sampling methods and the methods of analysis for the official control of the levels of ochratoxin A in foodstuffs(4) is to be incorporated into the Agreement.

(5) Commission Directive 2002/27/EC of 13 March 2002 amending Directive 98/53/EC laying down the sampling methods and the methods of analysis for the official control of the levels for certain contaminants in foodstuffs(5) is to be incorporated into the Agreement.

(6) Commission Regulation (EC) No 563/2002 of 2 April 2002 amending Regulation (EC) No 466/2001 setting maximum levels for certain contaminants in foodstuffs(6), as corrected by OJ L 155, 14.6.2002, p. 63, is to be incorporated into the Agreement.

(7) Commission Regulation (EC) No 622/2002 of 11 April 2002 establishing deadlines for the submission of information for the evaluation of chemically defined flavouring substances used in or on foodstuffs(7) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter XII of Annex II to the Agreement shall be amended as follows.

1. The following indent shall be added in point 54b (Council Regulation (EEC) No 2092/91):

"- 32002 R 0473: 'Commission Regulation (EC) No 473/2002 of 15 March 2002 (OJ L 75, 16.3.2002, p. 21)'."

2. The following shall be added in point 54s (Commission Directive 98/53/EC):

", as amended by:

- 32002 L 0027: Commission Directive 2002/27/EC of 13 March 2002 (OJ L 75, 16.3.2002, p. 44)."

3. The following indents shall be added in point 54zn (Commission Regulation (EC) No 466/2001):

"- 32002 R 0472: Commission Regulation (EC) No 472/2002 of 12 March 2002 (OJ L 75, 16.3.2002, p. 18),

- 32002 R 0563: Commission Regulation (EC) No 563/2002 of 2 April 2002 (OJ L 86, 3.4.2002, p. 5), as corrected by OJ L 155, 14.6.2002, p. 63."

4. The following points shall be inserted after point 54zw (Commission Decision 2002/80/EC):

"54zx. 32002 L 0026: Commission Directive 2002/26/EC of 13 March 2002 laying down the sampling methods and the methods of analysis for the official control of the levels of ochratoxin A in foodstuffs (OJ L 75, 16.3.2002, p. 38).

54zy. 32002 R 0622: Commission Regulation (EC) No 622/2002 of 11 April 2002 establishing deadlines for the submission of information for the evaluation of chemically defined flavouring substances used in or on foodstuffs (OJ L 95, 12.4.2002, p. 10)."

Article 2

The texts of Regulations (EC) No 472/2002, (EC) No 473/2002, (EC) No 563/2002, as corrected by OJ L 155, 14.6.2002, p. 63, and Regulation (EC) No 622/2002 and Directives 2002/26/EC and 2002/27/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 7 December 2002 provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(8).

Article 4

This Decision shall be published in the EEA section of, and in the EEA Supplement to, the Official Journal of the European Union.
