amending Annex XVI (Procurement) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as adjusted by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex XVI to the Agreement was amended by Decision No 20/2000 of the EEA Joint Committee of 25 February 2000(1).

(2) Commission Directive 2001/78/EC of 13 September 2001 amending Annex IV to Council Directive 93/36/EEC, Annexes IV, V and VI to Council Directive 93/37/EEC, Annexes III and IV to Council Directive 92/50/EEC, as amended by Directive 97/52/EC, and Annexes XII to XV, XVII and XVIII to Council Directive 93/38/EEC, as amended by Directive 98/4/EC (Directive on the use of standard forms in the publication of public contract notices)(2), as corrected by OJ L 214, 9.8.2002, p. 1, is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

The following indent shall be added in points 2 (Council Directive 93/37/EEC), 3 (Council Directive 93/36/EEC), 4 (Council Directive 93/38/EEC) and 5b (Council Directive 92/50/EEC) of Annex XVI to the Agreement:

"- 32001 L 0078: Commission Directive 2001/78/EC of 13 September 2001 (OJ L 285, 29.10.2001, p. 1), as corrected by OJ L 214, 9.8.2002, p. 1."

Article 2

The text of Directive 2001/78/EC, as corrected by OJ L 214, 9.8.2002, p. 1, in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 3

This Decision shall enter into force on 9 November 2002, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(3).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Communities.
