amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex II to the Agreement was amended by Decision No 100/2002 of the EEA Joint Committee of 12 July 2002(1).

(2) Commission Directive 2002/5/EC of 30 January 2002 amending Annex II to Council Directive 90/642/EEC as regards the fixing of maximum levels for pesticide residues in and on certain products of plant origin, including fruit and vegetables(2) is to be incorporated into the Agreement.

(3) Commission Regulation (EC) No 221/2002 of 6 February 2002 amending Regulation (EC) No 466/2001 setting maximum levels for certain contaminants in foodstuffs(3) is to be incorporated into the Agreement.

(4) Commission Decision 2002/113/EC of 23 January 2002 amending Commission Decision 1999/217/EC as regards the register of flavouring substances used in or on foodstuffs(4) is to be incorporated into the Agreement.

(5) Commission Directive 2002/23/EC of 26 February 2002 amending the Annexes to Council Directives 86/362/EEC, 86/363/EEC and 90/642/EEC as regards the fixing of maximum levels for pesticide residues in and on cereals, foodstuffs of animal origin and certain products of plant origin, including fruit and vegetables respectively(5) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter XII of Annex II to the Agreement shall be amended as follows:

1. the following indent shall be added in points 38 (Council Directive 86/362/EEC), 39 (Council Directive 86/363/EEC) and 54 (Council Directive 90/642/EEC):

"- 32002 L 0023: Commission Directive 2002/23/EC of 26 February 2002 (OJ L 64, 7.3.2002, p. 13).";

2. the following indent shall be added in point 54 (Council Directive 90/642/EEC):

"- 32002 L 0005: Commission Directive 2002/5/EC of 30 January 2002 (OJ L 34, 5.2.2002, p. 7).";

3. the following indent shall be added in point 54v (Commission Decision 1999/217/EC):

"- 32002 D 0113: Commission Decision 2002/113/EC of 23 January 2002 (OJ L 49, 20.2.2002, p. 1).";

4. the following indent shall be added in point 54zn (Commission Regulation (EC) No 466/2001):

"- 32001 R 0221: Commission Regulation (EC) No 221/2002 of 6 February 2002 (OJ L 37, 7.2.2002, p. 4)."

Article 2

The texts of Directives 2002/5/EC and 2002/23/EC, Regulation (EC) No 221/2002 and Decision 2002/113/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 3

This Decision shall enter into force on 9 November 2002, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(6).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Communities.
