amending Annex XIV (Competition) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex XIV to the Agreement was amended by Decision of the EEA Joint Committee No 96/2001 of 13 July 2001(1).

(2) Commission Regulation (EC) No 1105/2002 of 25 June 2002 amending Regulation (EEC) No 1617/93 as regards consultations on passenger tariffs and slot allocation at airports(2) is to be incorporated into the Agreement.

(3) Regulation (EEC) No 1617/93(3) was last amended by Regulation (EC) No 1324/2001(4) to extend the block exemption in respect of consultations on passenger tariffs until 30 June 2002 and the block exemption in respect of slot allocation and airport scheduling until 30 June 2004. As the block exemption in respect of consultations on passenger tariffs expired on 30 June 2002, this Decision will apply from 1 July 2002,

HAS DECIDED AS FOLLOWS:

Article 1

The following indent shall be added in point 11b (Commission Regulation (EEC) No 1617/93) in Annex XIV to the Agreement:

"- 32002 R 1105: Commission Regulation (EC) No 1105/2002 of 25 June 2002 (OJ L 167, 26.6.2002, p. 6)."

Article 2

The texts of Regulation (EC) No 1105/2002 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 3

This Decision shall enter into force on 28 September 2002, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(5).

It shall apply from 1 July 2002.

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Communities.
