amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex I to the Agreement was amended by Decision of the EEA Joint Committee No 78/2002 of 25 June 2002(1).

(2) Commission Decision 2001/746/EC of 17 October 2001 concerning additional guarantees relating to Aujeszky's disease for pigs destined for certain parts of the territory of Germany and amending Decisions 93/24/EEC, 93/244/EEC and 2001/618/EC(2) is to be incorporated into the Agreement.

(3) Commission Decision 2001/808/EC of 14 November 2001 amending Decision 2001/296/EC as regards the list of approved laboratories for checking the effectiveness of vaccination against rabies in certain domestic carnivores(3) is to be incorporated into the Agreement.

(4) Commission Decision 2001/867/EC of 3 December 2001 amending Council Directive 90/539/EEC as regards health certificates for intra-Community trade in poultry and hatching eggs(4) is to be incorporated into the Agreement.

(5) Commission Decision 2001/905/EC of 18 December 2001 approving the Aujeszky's disease eradication programme presented by Belgium and the Netherlands, concerning additional guarantees for pigs destined for the territory of Belgium and the Netherlands and amending Decisions 93/244/EEC and 2001/618/EC(5) is to be incorporated into the Agreement.

(6) This Decision is not to apply to Iceland and Liechtenstein,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter I of Annex I to the Agreement shall be amended as specified in the Annex to this Decision.

Article 2

The texts of Decisions 2001/746/EC, 2001/808/EC, 2001/867/EC and 2001/905/EC in the Norwegian language, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 3

This Decision shall enter into force on 28 September 2002, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(6).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Communities.

ANNEX

to Decision of the EEA Joint Committee No 118/2002

Chapter I of Annex I to the Agreement shall be amended as specified below.

1. The following indent shall be added in point 4 (Council Directive 90/539/EEC) in part 4.1 and in point 3 (Council Directive 90/539/EEC) in Part 8.1:

"- 32001 D 0867: Commission Decision 2001/867/EC of 3 December 2001 (OJ L 323, 7.12.2001, p. 29)."

2. The following shall be added in point 64 (Commission Decision 2001/618/EC) in part 4.2:

", as amended by:

- 32001 D 0746: Commission Decision 2001/746/EC of 17 October 2001 (OJ L 278, 23.10.2001, p. 41)."

3. The following indent shall be added in point 64 (Commission Decision 2001/618/EC) in part 4.2:

"- 32001 D 0905: Commission Decision 2001/905/EC of 18 December 2001 (OJ L 335, 19.12.2001, p. 22)."

4. The following shall be added in point 62 (Commission Decision 2001/296/EC) in part 4.2:

", as amended by:

- 32001 D 0808: Commission Decision 2001/808/EC of 14 November 2001 (OJ L 305, 22.11.2001, p. 30)."

5. The following point shall be inserted after point 50 (Commission Decision 2001/576/EC) under the heading "ACTS OF WHICH THE EFTA STATES AND THE EFTA SURVEILLANCE AUTHORITY SHALL TAKE DUE ACCOUNT" in part 4.2:

"51. 32001 D 0905: Commission Decision 2001/905/EC of 18 December 2001 approving the Aujeszky's disease eradication programme presented by Belgium and the Netherlands, concerning additional guarantees for pigs destined for the territory of Belgium and the Netherlands and amending Decisions 93/244/EEC and 2001/618/EC (OJ L 335, 19.12.2001, p. 22)."
