amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex I to the Agreement was amended by Decision of the EEA Joint Committee No 78/2002 of 25 June 2002(1).

(2) Five acts regarding control measures, notification of diseases and animal health exchange and placing on the market of live animals, are to be incorporated into the Agreement.

(3) This Decision is not to apply to Liechtenstein,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter I of Annex I to the Agreement shall be amended as specified in the Annex to this Decision.

Article 2

The texts of Decisions 2001/498/EC(2), 2001/541/EC(3), 2001/552/EC(4), 2001/553/EC(5) and 2001/576/EC(6) in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 3

This Decision shall enter into force on 28 September 2002, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(7).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Communities.

ANNEX

to the Decision of the EEA Joint Committee No 117/2002

Chapter I of Annex I to the Agreement shall be amended as specified below.

1. The following indents shall be added in point 29 (Commission Decision 95/124/EC) in part 4.2:

"- 32001 D 0498: Commission Decision 2001/498/EC of 19 June 2001 (OJ L 181, 4.7.2001, p. 32),

- 32001 D 0541: Commission Decision 2001/541/EC of 9 July 2001 (OJ L 194, 18.7.2001, p. 51)."

2. The following indent shall be added in point 30 (Commission Decision 95/125/EC) in part 4.2:

"- 32001 D 0553: Commission Decision 2001/553/EC of 12 July 2001 (OJ L 199, 24.7.2001, p. 26)."

3. The following indent shall be added in point 48 (Commission Decision 98/357/EC) in part 4.2:

"- 32001 D 0552: Commission Decision 2001/552/EC of 11 July 2001 (OJ L 199, 24.7.2001, p. 23)."

4. The following point shall be inserted after point 49 (Commission Decision 2000/312/EC) in part 4.2 under the heading "ACTS OF WHICH THE EFTA STATES AND THE EFTA SURVEILLANCE AUTHORITY SHALL TAKE DUE ACCOUNT":

"50. 32001 D 0576: Commission Decision 2001/576/EC of 13 July 2001 approving the programmes submitted by Italy for obtaining the status of approved zones and of farms in non-approved zones with regard to infectious haematopoietic necrosis and viral haemorrhagic septicaemia and repealing Commission Decisions 98/359/EC and 2000/310/EC (OJ L 203, 28.7.2001, p. 23).

This act applies also to Iceland."

5. The text of point 6 (Commission Decision 98/359/EC) in part 3.2 and point 48 (Commission Decision 2000/310/EC) in part 4.2 both under the headings "ACTS OF WHICH THE EFTA STATES AND THE EFTA SURVEILLANCE AUTHORITY SHALL TAKE DUE ACCOUNT" shall be deleted.
