amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex I to the Agreement was amended by Decision of the EEA Joint Committee No 78/2002 of 25 June 2002(1).

(2) Four acts regarding control matters, control measures, notification of diseases, and animal health, exchange and placing on the market of live animals, are to be incorporated into the Agreement.

(3) Commission Decision 2001/618/EC repeals Decisions 93/24/EEC and 93/244/EEC, which are incorporated into the Agreement and which are consequently to be deleted from the Agreement.

(4) This Decision is not to apply to Iceland and Liechtenstein,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter I of Annex I to the Agreement shall be amended as specified in the Annex to this Decision.

Article 2

The texts of Decisions 2001/525/EC(2), 2001/577/EC(3), 2001/618/EC(4) and 2001/660/EC(5) in the Norwegian language, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 3

This Decision shall enter into force on 28 September 2002, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(6).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Communities.

ANNEX

to Decision of the EEA Joint Committee No 112/2002

Chapter I of Annex I to the Agreement shall be amended as specified below.

1. The following point shall be inserted after point 13 (Commission Decision 2001/399/EC) in part 1.2 under the heading "ACTS OF WHICH THE EFTA STATES AND THE EFTA SURVEILLANCE AUTHORITY SHALL TAKE DUE ACCOUNT":

"14. 32001 D 0577: Commission Decision 2001/577/EC of 25 July 2001 setting the date on which dispatch from Portugal of bovine products under the Date-Based Export Scheme may commence by virtue of Article 22(2) of Decision 2001/376/EC (OJ L 203, 28.7.2001, p. 27)."

2. The following indent shall be added in point 13 (Commission Decision 2000/112/EC) in part 3.2:

"- 32001 D 0660: Commission Decision 2001/660/EC of 6 August 2001 (OJ L 232, 30.8.2001, p. 23)."

3. The following shall be added in point 12 (Commission Decision 2000/680/EC) in part 3.2 under the heading "ACTS OF WHICH THE EFTA STATES AND THE EFTA SURVEILLANCE AUTHORITY SHALL TAKE DUE ACCOUNT":

", as amended by:

- 32001 D 0525: Commission Decision 2001/525/EC of 28 June 2001 (OJ L 190, 12.7.2001, p. 24)."

4. The following point shall be inserted after point 63 (Commission Decision 2001/183/EC) in part 4.2:

"64. 32001 D 0618: Commission Decision 2001/618/EC of 23 July 2001 on additional guarantees in intra-Community trade of pigs relating to Aujeszky's disease, criteria to provide information on this disease and repealing Decisions 93/24/EEC and 93/244/EEC (OJ L 215, 9.8.2001, p. 48)."

5. The text of points 9 (Commission Decision 93/24/EEC) and 19 (Commission Decision 93/244/EEC) in part 4.2 shall be deleted.
