Decision of the EEA Joint Committee
No 100/2002
of 12 July 2002
amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,
Whereas:
(1) Annex II to the Agreement was amended by Decision No 81/2002 of the EEA Joint Committee of 25 June 2002(1).
(2) Commission Regulation (EC) No 257/2002 of 12 February 2002 amending Regulation (EC) No 194/97 setting maximum levels for certain contaminants in foodstuffs and Regulation (EC) No 466/2001 setting maximum levels for certain contaminants in foodstuffs(2) is to be incorporated into the Agreement.
(3) Commission Directive 2002/16/EC of 20 February 2002 on the use of certain epoxy derivatives in materials and articles intended to come into contact with foodstuffs(3) is to be incorporated into the Agreement.
(4) Commission Directive 2002/17/EC of 21 February 2002 amending Directive 90/128/EEC relating to plastic materials and articles intended to come into contact with foodstuffs(4) is to be incorporated into the Agreement.
(5) Directive 2002/16/EC repeals Commission Directive 2001/61/EC(5), which is incorporated into the Agreement, and which is consequently to be deleted from the Agreement,
HAS DECIDED AS FOLLOWS:
Article 1
Chapter XII of Annex II to the Agreement shall be amended as follows:
1. the following indent shall be added in point 52 (Commission Directive 90/128/EEC):
"- 32002 L 0017: Commission Directive 2002/17/EC of 21 February 2002 (OJ L 58, 28.2.2002, p. 19).";
2. the following indent shall be added in point 54zn (Commission Regulation (EC) No 66/2001):
"- 32002 R 0257: Commission Regulation (EC) No 257/2002 of 12 February 2002 (OJ L 41, 13.2.2002, p. 12).";
3. the following point shall be inserted after point 54zs (Council Directive 2001/114/EC):
"54zt. 32002 L 0016: Commission Directive 2002/16/EC of 20 February 2002 on the use of certain epoxy derivatives in materials and articles intended to come into contact with foodstuffs (OJ L 51, 22.2.2002, p. 27).";
4. The text of point 54zk (Commission Directive 2001/61/EC) shall be deleted.
Article 2
The texts of Regulation (EC) No 257/2002 and Directives 2002/16/EC and 2002/17/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.
Article 3
This Decision shall enter into force on 13 July 2002, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(6).
Article 4
This Decision shall be published in the EEA section of, and in the EEA Supplement to, the Official Journal of the European Communities.
