amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex II to the Agreement was amended by Decision No 81/2002 of the EEA Joint Committee of 25 June 2002(1).

(2) Council Directive 2001/110/EC of 20 December 2001 relating to honey(2) is to be incorporated into the Agreement.

(3) Council Directive 2001/111/EC of 20 December 2001 relating to certain sugars intended for human consumption(3) is to be incorporated into the Agreement.

(4) Council Directive 2001/112/EC of 20 December 2001 relating to fruit juices and certain similar products intended for human consumption(4) is to be incorporated into the Agreement.

(5) Council Directive 2001/113/EC of 20 December 2001 relating to fruit jams, jellies and marmalades and sweetened chestnut purée intended for human consumption(5) is to be incorporated into the Agreement.

(6) Council Directive 2001/114/EC of 20 December 2001 relating to certain partly or wholly dehydrated preserved milk for human consumption(6) is to be incorporated into the Agreement.

(7) Directive 2001/110/EC repeals Council Directive 74/409/EEC(7) with effect from 1 August 2003, which is incorporated in the Agreement and which is consequently to be repealed under the Agreement.

(8) Directive 2001/111/EC repeals Council Directive 73/437/EEC(8) with effect from 12 July 2003, which is incorporated in the Agreement and which is consequently to be repealed under the Agreement.

(9) Directive 2001/112/EC repeals Council Directive 93/77/EEC(9) with effect from 12 July 2003, which is incorporated in the Agreement and which is consequently to be repealed under the Agreement.

(10) Directive 2001/113/EC repeals Council Directive 79/693/EEC(10) with effect from 12 July 2003, which is incorporated in the Agreement and which is consequently to be repealed under the Agreement.

(11) Directive 2001/114/EC repeals Council Directive 76/118/EEC(11) with effect from 17 July 2003, which is incorporated in the Agreement and which is consequently to be repealed under the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter XII of Annex II to the Agreement shall be amended as follows:

1. the following shall be inserted after point 54zn (Commission Regulation (EC) No 466/2001):

"54zo. 32001 L 0110: Council Directive 2001/110/EC of 20 December 2001 relating to honey (OJ L 10, 12.1.2002, p. 47).

54zp. 32001 L 0111: Council Directive 2001/111/EC of 20 December 2001 relating to certain sugars intended for human consumption (OJ L 10, 12.1.2002, p. 53).

54zq. 32001 L 0112: Council Directive 2001/112/EC of 20 December 2001 relating to fruit juices and certain similar products intended for human consumption (OJ L 10, 12.1.2002, p. 58).

54zr. 32001 L 0113: Council Directive 2001/113/EC of 20 December 2001 relating to fruit jams, jellies and marmalades and sweetened chestnut purée intended for human consumption (OJ L 10, 12.1.2002, p. 67).

54zs. 32001 L 0114: Council Directive 2001/114/EC of 20 December 2001 relating to certain partly or wholly dehydrated preserved milk for human consumption (OJ L 15, 17.1.2002, p. 19).

The provisions of the Directive shall, for the purposes of the present Agreement, be read with the following adaptation:

the following shall be added in Annex II:

'(k) The Icelandic term 'niðurseydd nýmjólk' and the Norwegian term 'fløtepulver' mean the product defined in Annex I(2)(a).'

2. the text of point 7 (Council Directive 73/437/EEC) shall be repealed with effect from 12 July 2003;

3. the text of point 9 (Council Directive 74/409/EEC) shall be repealed with effect from 1 August 2003;

4. the text of point 11 (Council Directive 76/118/EEC) shall be repealed with effect from 17 July 2003;

5. the text of point 19 (Council Directive 79/693/EEC) shall be repealed with effect from 12 July 2003;

6. the text of point 54m (Council Directive 93/77/EEC) shall be repealed with effect from 12 July 2003.

Article 2

The texts of Directives 2001/110/EC, 2001/111/EC, 2001/112/EC, 2001/113/EC and 2001/114/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 3

This Decision shall enter into force on 13 July 2002, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(12).

Article 4

This Decision shall be published in the EEA section of, and in the EEA Supplement to, the Official Journal of the European Communities.
