amending Annex VII (Mutual recognition of professional qualifications) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular 98 thereof,

Whereas:

(1) Annex VII to the Agreement was amended by Decision of the EEA Joint Committee No 55/2001 of 18 May 2001(1).

(2) The European Commission, in its Communication to the European Parliament and the Council on the SLIM initiative, undertook to present proposals aimed at simplifying the updating of the lists of qualifications eligible for automatic recognition: As Council Directive 93/16/EEC of 5 April 1993 to facilitate the free movement of doctors and the mutual recognition of their diplomas, certificates and other evidence of formal qualifications(2) provided for a simple procedure in the case of general practitioners' qualifications, and as experience had shown that the procedure afforded sufficient legal certainty, it was considered desirable to extend that procedure to qualifications held by nurses responsible for general care, dental practitioners, veterinary surgeons, midwives, pharmacists and doctors.

(3) Directive 2001/19/EC of the European Parliament and of the Council of 14 May 2001 amending Council Directives 89/48/EEC and 92/51/EEC on the general system for the recognition of professional qualifications and Council Directives 77/452/EEC, 77/453/EEC, 78/686/EEC, 78/687/EEC, 78/1026/EEC, 78/1027/EEC, 80/154/EEC, 80/155/EEC, 85/384/EEC, 85/432/EEC, 85/433/EEC and 93/16/EEC concerning the profession of nurse responsible for general care, dental practitioner, veterinary surgeon, midwife, architect, pharmacist and doctor(3) is to be incorporated into the Agreement.

(4) Certain adaptations made by Chapter XI.D.I of Annex I to the Act concerning the conditions of accession of the Republic of Austria, the Republic of Finland and the Kingdom of Sweden and the adjustments to the Treaties on which the European Union is founded(4) are to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

The following shall be added to point 1 (Council Directive 89/48/EEC) of Annex VII to the Agreement:

", as amended by:

- 32001 L 0019: Directive 2001/19/EC of the European Parliament and of the Council of 14 May 2001 (OJ L 206, 31.7.2001, p. 1)."

Article 2

Point 1a (Council Directive 92/51/EEC) of Annex VII to the Agreement shall be amended as follows:

1. the following indent shall be inserted between the first and second indents:

"- 1 94 N: Act concerning the conditions of accession of the Republic of Austria, the Republic of Finland and the Kingdom of Sweden and the adjustments to the Treaties on which the European Union is founded (OJ C 241, 29.8.1994, p. 21 as adjusted by OJ L 1, 1.1.1995, p. 1).";

2. the following indent shall be added:

"- 32001 L 0019: Directive 2001/19/EC of the European Parliament and of the Council of 14 May 2001 (OJ L 206, 31.7.2001, p. 1)."

Article 3

Point 4 (Council Directive 93/16/EEC) of Annex VII to the Agreement shall be amended as follows:

1. the following indent shall be added:

"- 32001 L 0019: Directive 2001/19/EC of the European Parliament and of the Council of 14 May 2001 (OJ L 206, 31.7.2001, p. 1).";

2. the text of adaptation (a) shall be deleted;

3. the text of adaptation (b) shall be replaced by the following:

"The content of the following table of titles of diplomas, certificates and other evidence of formal qualifications in medicine in the EEA EFTA States shall be added to Annex A to the Directive:

4. The text of adaptation (c) shall be replaced by the following:

"The content of the following table of titles of diplomas, certificates and other evidence of formal qualifications in specialised medicine in the EEA EFTA States shall be added to Annex B to the Directive:

5. The text of adaptation (d) shall be replaced by the following:

"The content of the following table of titles of training courses in specialised medicine in the EEA EFTA States shall be added to Annex C to the Directive:

6. The text of adaptation (e) shall be deleted.

Article 4

The text of point 7 (List 90/C 268/02) shall be deleted.

Article 5

Point 8 (Council Directive 77/452/EEC) of Annex VII to the Agreement shall be amended as follows:

1. the following indent shall be added:

"- 32001 L 0019: Directive 2001/19/EC of the European Parliament and of the Council of 14 May 2001 (OJ L 206, 31.7.2001, p. 1).";

2. the words "offentlig godkjent" under the heading "in Norway" in adaptation (a) shall be deleted;

3. the text of adaptation (b) shall be replaced by the following:

"The content of the following table of titles of diplomas, certificates and other evidence of formal qualifications in nursing (general care) in the EEA EFTA States shall be added to the Annex to the Directive:

Article 6

The following indent shall be added to point 9 (Council Directive 77/453/EEC) of Annex VII to the Agreement:

Article 7

Point 10 (Council Directive 78/686/EEC) of Annex VII to the Agreement shall be amended as follows:

1. the following indent shall be added:

"- 32001 L 0019: Directive 2001/19/EC of the European Parliament and of the Council of 14 May 2001 (OJ L 206, 31.7.2001, p. 1)."

2. The text of adaptation (b) shall be replaced by the following:

"The content of the following table titles of diplomas, certificates and other evidence of formal qualifications in dentistry in the EEA EFTA States shall be added to Annex A to the Directive:

3. The texts of adaptation (c) shall be replaced by the following:

Article 8

The following shall be added in point 11 (Council Directive 78/687/EEC) of Annex VII to the Agreement:

Article 9

Point 12 (Council Directive 78/1026/EEC) of Annex VII to the Agreement shall be amended as follows:

1. the following indent shall be added:

"- 32001 L 0019: Directive 2001/19/EC of the European Parliament and of the Council of 14 May 2001 (OJ L 206, 31.7.2001, p. 1).";

2. the adaptation text shall be replaced by the following:

"The content of the following table of titles of diplomas, certificates and other evidence of formal qualifications in veterinary surgery in the EEA EFTA States shall be added to the Annex to the Directive:

Article 10

The following indent shall be added in point 13 (Council Directive 78/1027/EEC) of Annex VII to the Agreement:

"- 32001 L 0019: Directive 2001/19/EC of the European Parliament and of the Council of 14 May 2001 (OJ L 206, 31.7.2001, p. 1)."

Article 11

Point 14 (Council Directive 80/154/EEC) of Annex VII to the Agreement shall be amended as follows:

1. the following indent shall be added:

"- 32001 L 0019: Directive 2001/19/EC of the European Parliament and of the Council of 14 May 2001 (OJ L 206, 31.7.2001, p. 1).";

2. the text of adaptation (b) shall be replaced by the following:

"The content of the following table of titles of diplomas, certificates and other evidence of formal qualifications in midwifery in the EEA EFTA States shall be added to the Annex to the Directive:

Article 12

The following indent shall be added to point 15 (Council Directive 80/155/EEC) of Annex VII to the Agreement:

"- 32001 L 0019: Directive 2001/19/EC of the European Parliament and of the Council of 14 May 2001 (OJ L 206, 31.7.2001, p. 1)."

Article 13

The following shall be added to point 16 (Council Directive 85/432/EEC) of Annex VII to the Agreement:

- 32001 L 0019: Directive 2001/19/EC of the European Parliament and of the Council of 14 May 2001 (OJ L 206, 31.7.2001, p. 1)."

Article 14

Point 17 (Council Directive 85/433/EEC) of Annex VII to the Agreement shall be amended as follows:

1. the following indent shall be added:

"- 32001 L 0019: Directive 2001/19/EC of the European Parliament and of the Council of 14 May 2001 (OJ L 206, 31.7.2001, p. 1)."

2. The text of adaptation (a) shall be replaced by the following:

"The content of the following table of titles of diplomas, certificates and other evidence of formal qualifications in pharmacy in the EEA EFTA States shall be added to the Annex to the Directive:

Article 15

The following indent shall be added in point 18 (Council Directive 85/384/EEC) of Annex VII to the Agreement:

Article 16

The text of point 19 (List 89/C 205/06) shall be deleted.

Article 17

The texts of Directive 2001/19/EC and of the adaptations to Directives 92/51/EEC made by Chapter XI.D.I, 93/16/EEC made by Chapter XI.D.III.1, 77/452/EEC made by Chapter XI.D.III.2, 78/686/EEC made by Chapter XI.D.III.3, 78/687/EEC made by Chapter XI.D.III.3, 78/1026/EEC made by Chapter XI.D.III.4, 80/154/EEC made by Chapter XI.D.III.5, 85/433/EEC made by Chapter XI.D.III.6, 85/384/EEC made by Chapter XI.D.IV of Annex I to the Act concerning the conditions of accession of the Republic of Austria, the Republic of Finland and the Kingdom of Sweden and the adjustments to the Treaties on which the European Union is founded, in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 18

This Decision shall enter into force on 26 June 2002, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(5).

Article 19

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Communities.
