amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 52/2002 of 31 May 2002(1).

(2) Directive 2001/82/EC of the European Parliament and of the Council of 6 November 2001 on the Community code relating to veterinary medicinal products(2) is to be incorporated into the Agreement.

(3) Directive 2001/83/EC of the European Parliament and of the Council of 6 November 2001 on the Community code relating to medicinal products for human use(3) is to be incorporated into the Agreement.

(4) Directives 2001/82/EC and 2001/83/EC repeal several acts already incorporated into the Agreement and which are consequently to be deleted from the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter XIII of Annex II to the Agreement shall be amended as follows:

1. The following points shall be inserted after point 15o (Directive 2001/20/EC of the European Parliament and of the Council):

"15p. 32001 L 0082: Directive 2001/82/EC of the European Parliament and of the Council of 6 November 2001 on the Community code relating to veterinary medicinal products (OJ L 311, 28.11.2001, p. 1).

15q. 32001 L 0083: Directive 2001/83/EC of the European Parliament and of the Council of 6 November 2001 on the Community code relating to medicinal products for human use (OJ L 311, 28.11.2001, p. 67)."

2. The text of points 1 (Council Directive 65/65/EEC), 2 (Council Directive 75/318/EEC), 3 (Second Council Directive 75/319/EEC), 5 (Council Directive 81/851/EEC), 6 (Council Directive 81/852/EEC), 10 (Council Directive 89/342/EEC), 11 (Council Directive 89/343/EEC), 12 (Council Directive 89/381/EEC), 13 (Council Directive 90/677/EEC), 15b (Council Directive 92/25/EEC), 15c (Council Directive 92/26/EEC), 15d (Council Directive 92/27/EEC) and 15e (Council Directive 92/28/EEC) shall be deleted.

Article 2

The texts of Directives 2001/82/EC and 2001/83/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 3

This Decision shall enter into force on 26 June 2002, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(4).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Communities.
