amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 51/2002 of 31 May 2002(1).

(2) Commission Regulation (EC) No 466/2001 of 8 March 2001 setting maximum levels for certain contaminants in foodstuffs(2), as corrected by OJ L 313, 30.11.2001, p. 60, is to be incorporated into the Agreement.

(3) Commission Directive 2001/54/EC of 11 July 2001 repealing Directive 79/1066/EEC laying down Community methods of analysis for testing coffee extracts and chicory extracts(3) is to be incorporated into the Agreement.

(4) Commission Directive 2001/101/EC of 26 November 2001 amending Directive 2000/13/EC of the European Parliament and of the Council on the approximation of the laws of the Member States relating to the labelling, presentation and advertising of foodstuffs(4) is to be incorporated into the Agreement.

(5) Council Regulation (EC) No 2375/2001 of 29 November 2001 amending Commission Regulation (EC) No 466/2001 setting maximum levels for certain contaminants in foodstuffs(5) is to be incorporated into the Agreement.

(6) Commission Decision 2001/873/EC of 4 December 2001 correcting Directive 2001/22/EC laying down the sampling methods and the methods of analysis for the official control of the levels of lead, cadmium, mercury and 3-MCPD in foodstuffs(6) is to be incorporated into the Agreement.

(7) Regulation (EC) No 466/2001 repeals, with effect from 5 April 2002, Commission Regulation (EC) No 194/97(7), which is incorporated in the Agreement and which is consequently to be deleted from the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter XII of Annex II to the Agreement shall be amended as follows:

1. The following shall be added in point 18 (Commission Directive 2000/13/EC):

", as amended by:

- 32001 L 0101: Commission Directive 2001/101/EC of 26 November 2001 (OJ L 310, 28.11.2001, p. 19)."

2. The following shall be added in point 54zj (Commission Directive 2001/22/EC):

", as amended by:

- 32001 D 0873: Commission Decision 2001/873/EC of 4 December 2001 (OJ L 325, 8.12.2001, p. 34)."

3. The following points shall be inserted after point 54zl (Commission Directive 96/5/EC):

"54zm. 32001 L 0054: Commission Directive 2001/54/EC of 11 July 2001 repealing Directive 79/1066/EEC laying down Community methods of analysis for testing coffee extracts and chicory extracts (OJ L 191, 13.7.2001, p. 42).

54zn. 32001 R 0466: Commission Regulation (EC) No 466/2001 of 8 March 2001 setting maximum levels for certain contaminants in foodstuffs (OJ L 77, 16.3.2001, p. 1), as corrected by OJ L 313, 30.11.2001, p. 60, as amended by:

- 32001 R 2375: Council Regulation (EC) No 2375/2001 of 29 November 2001 (OJ L 321, 6.12.2001, p. 1)."

4. The text of point 22 (Commission Directive 79/1066/EEC) shall be deleted.

5. The text of point 54r (Commission Regulation (EC) No 194/97) shall be deleted.

Article 2

The texts of Directives 2001/54/EC and 2001/101/EC, Regulations (EC) Nos 466/2001, as corrected by OJ L 313, 30.11.2001, p. 60, and 2375/2001 and Decision 2001/873/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 3

This Decision shall enter into force on 26 June 2002, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(8).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Communities.
