amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex I to the Agreement was amended by Decision of the EEA Joint Committee No 149/2001 of 11 December 2001(1).

(2) Six acts concerning animal health - exchange and placing on the market of live animals - are to be incorporated into the Agreement.

(3) Commission Decisions 97/315/EC(2), 97/262/EC(3), 97/263/EC(4) and 1999/465/EC(5) which are already incorporated into the Agreement, should be moved to another point in Chapter I of Annex I to the Agreement.

(4) This Decision is not to apply to Iceland and Liechtenstein,

HAS DECIDED AS FOLLOWS:

Article 1

Part 4.2 of Chapter I of Annex I to the Agreement shall be amended as specified in the Annex to this Decision.

Article 2

The texts of Decisions 2001/24/EC(6), 2001/26/EC(7), 2001/28/EC(8), 2001/106/EC(9), 2001/292/EC(10) and 2001/296/EC(11) in the Norwegian language, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 3

This Decision shall enter into force on 26 June 2002, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(12).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Communities.

6. Under the heading ACTS OF WHICH THE EFTA STATES AND THE EFTA SURVEILLANCE AUTHORITY SHALL TAKE DUE ACCOUNT, the text of points 43 (Commission Decision 97/262/EC), 44 (Commission Decision 97/263/EC) and 46 (Commission Decision 99/465/EC) shall be deleted.
