amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex I to the Agreement was amended by Decision of the EEA Joint Committee No 149/2001 of 11 December 2001(1).

(2) Ten acts regarding control measures - notification of diseases - are to be incorporated into the Agreement.

(3) Decision 2001/138/EC(2) repeals Commission Decisions 2000/350/EC(3), 2000/598/EC(4), 2000/685/EC(5), 2000/715/EC(6) and 2000/734/EC(7), which are incorporated into the Agreement and which are consequently to be deleted from the Agreement.

(4) This Decision is not to apply to Iceland and Liechtenstein,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter I of Annex I to the Agreement shall be amended as specified in the Annex to this Decision.

Article 2

The texts of Decisions 2001/96/EC(8), 2001/138/EC, 2001/140/EC(9), 2001/181/EC(10), 2001/246/EC(11), 2001/257/EC(12), 2001/279/EC(13), 2001/295/EC(14), 2001/303/EC(15) and 2001/326/EC(16) in the Norwegian language, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 3

This Decision shall enter into force on 26 June 2002, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(17).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Communities.

Part 3.2 of Chapter I of Annex I to the Agreement shall be amended as specified below.

5. The text of points 103 (Commission Decision 2000/350/EC), 105 (Commission Decision 2000/598/EC), 107 (Commission Decision 2000/685/EC), 108 (Commission Decision 2000/715/EC) and 109 (Commission Decision 2000/734/EC) in Part 1.2 shall be deleted.

6. The following point shall be inserted after point 12 (Commission Decision 2000/680/EC) in Part 3.2 under the heading "ACTS OF WHICH THE EFTA STATES AND THE EFTA SURVEILLANCE AUTHORITY SHALL TAKE DUE ACCOUNT":

13. 32001 D 0140: Commission Decision 2001/140/EC of 12 February 2001 approving the plan presented by Austria for the eradication of classical swine fever in feral pigs in the Province of Lower Austria (OJ L 50, 21.2.2001, p. 22).
