amending Annex XIII (Transport) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex XIII to the Agreement was amended by Decision No 38/2002 of the EEA Joint Committee of 19 April 2002(1).

(2) Directive 2001/96/EC of the European Parliament and of the Council of 4 December 2001 establishing harmonised requirements and procedures for the safe loading and unloading of bulk carriers(2) is to be incorporated into the Agreement.

(3) Directive 2001/105/EC of the European Parliament and of the Council of 19 December 2001 amending Council Directive 94/57/EC on common rules and standards for ship inspection and survey organisations and for the relevant activities of maritime administrations(3) is to be incorporated into the Agreement.

(4) Directive 2001/106/EC of the European Parliament and of the Council of 19 December 2001 amending Council Directive 95/21/EC concerning the enforcement, in respect of shipping using Community ports and sailing in the waters under the jurisdiction of the Member States, of international standards for ship safety, pollution prevention and shipboard living and working conditions (port State control)(4) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

The following point shall be added after point 56j (Directive 2001/25/EC of the European Parliament and of the Council) of Annex XIII to the Agreement: "56k. 32001 L 0096: Directive 2001/96/EC of the European Parliament and of the Council of 4 December 2001 establishing harmonised requirements and procedures for the safe loading and unloading of bulk carriers (OJ L 13, 16.1.2002, p. 9)."

Article 2

The following indent shall be added in point 55b (Council Directive 94/57/EC) of Annex XIII to the Agreement: "- 32001 L 0105: Directive 2001/105/EC of the European Parliament and of the Council of 19 December 2001 (OJ L 19, 22.1.2002, p. 9)."

Article 3

The following indent shall be added in point 56b (Council Directive 95/21/EC) of Annex XIII to the Agreement: "- 32001 L 0106: Directive 2001/106/EC of the European Parliament and of the Council of 19 December 2001 (OJ L 19, 22.1.2002, p. 17)."

Article 4

The texts of Directives 2001/96/EC, 2001/105/EC and 2001/106/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 5

This Decision shall enter into force on 1 June 2002, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(5).

Article 6

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Communities.
