amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex II to the Agreement was amended by Decision No 14/2002 of the EEA Joint Committee of 1 March 2002(1).

(2) Commission Directive 2000/80/EC of 4 December 2000 amending Annex I to Council Directive 91/414/EEC concerning the placing of plant-protection products on the market, so as to consolidate that Annex and include a further active substance (lambda-cyhalothrin)(2) is to be incorporated into the Agreement.

(3) Commission Directive 2001/87/EC of 12 October 2001 amending Annex I to Council Directive 91/414/EEC concerning the placing of plant-protection products on the market to include acibenzolar-s-methyl, cyclanilide, ferric phosphate, pymetrozine and pyraflufen-ethyl as active substances(3) is to be incorporated into the Agreement.

(4) Commission Directive 2001/99/EC of 20 November 2001 amending Annex I to Council Directive 91/414/EEC concerning the placing of plant-protection products on the market to include glyphosate and thifensulphuron-methyl as active substances(4) is to be incorporated into the Agreement.

(5) Commission Directive 2001/103/EC of 28 November 2001 amending Annex I to Council Directive 91/414/EEC concerning the placing of plant-protection products on the market to include 2,4-dichlorophenoxy acetic acid (2,4-D) as an active substance(5) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

The 11th (Commission Directive 97/73/EC), 12th (Directive 98/47/EC), 13th (Directive 1999/1/EC), 14th (Directive 1999/73/EC), 15th (Directive 1999/80/EC), 16th (Directive 2000/10/EC), 17th (Directive 2000/49/EC), 18th (Directive 2000/50/EC), 19th (Directive 2000/66/EC), 20th (Directive 2000/67/EC) and 21st (Directive 2000/68/EC) indents in point 12a (Council Directive 91/414/EEC) in Chapter XV of Annex II to the Agreement shall be deleted.

Article 2

The following indents shall be added in point 12a (Council Directive 91/414/EEC) of Chapter XV of Annex II to the Agreement: "- 32000 L 0080: Commission Directive 2000/80/EC of 4 December 2000 (OJ L 309, 9.12.2000, p. 14),

- 32001 L 0087: Commission Directive 2001/87/EC of 12 October 2001 (OJ L 276, 19.10.2001, p. 17),

- 32001 L 0099: Commission Directive 2001/99/EC of 20 November 2001 (OJ L 304, 21.11.2001, p. 14),

- 32001 L 0103: Commission Directive 2001/103/EC of 28 November 2001 (OJ L 313, 30.11.2001, p. 37)."

Article 3

The texts of Directives 2000/80/EC, 2001/87/EC, 2001/99/EC and 2001/103/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 4

This Decision shall enter into force on 1 June 2002, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(6).

Article 5

This Decision shall be published in the EEA section of, and in the EEA Supplement to, the Official Journal of the European Communities.
