amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex II to the Agreement was amended by Decision No 14/2002 of the EEA Joint Committee of 1 March 2002(1).

(2) Commission Directive 2001/90/EC of 26 October 2001 adapting to technical progress for the seventh time Annex I to Council Directive 76/769/EEC on the approximation of the laws, regulations and administrative provisions of the Member States relating to restrictions on the marketing and use of certain dangerous substances and preparations (creosote)(2) is to be incorporated into the Agreement.

(3) Commission Directive 2001/91/EC of 29 October 2001 adapting to technical progress for the eighth time Annex I to Council Directive 76/769/EEC on the approximation of the laws, regulations and administrative provisions of the Member States relating to restrictions on the marketing and use of certain dangerous substances and preparations (hexachloroethane)(3) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

The following indents shall be added in point 4 (Council Directive 76/769/EEC) of Chapter XV of Annex II to the Agreement: "- 32001 L 0090: Commission Directive 2001/90/EC of 26 October 2001 (OJ L 283, 27.10.2001, p. 41),

- 32001 L 0091: Commission Directive 2001/91/EC of 29 October 2001 (OJ L 286, 30.10.2001, p. 27)."

Article 2

The texts of Directives 2001/90/EC and 2001/91/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 3

This Decision shall enter into force on 1 June 2002, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(4).

Article 4

This Decision shall be published in the EEA section of, and in the EEA Supplement to, the Official Journal of the European Communities.
