amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex II to the Agreement was amended by Decision No 32/2002 of the EEA Joint Committee of 19 April 2002(1).

(2) Commission Directive 2001/48/EC of 28 June 2001 amending the Annexes to Council Directives 86/362/EEC and 90/642/EEC on the fixing of maximum levels for pesticide residues in and on cereals and certain products of plant origin, including fruit and vegetables respectively(2) is to be incorporated into the Agreement.

(3) Commission Directive 2001/57/EC of 25 July 2001 amending the Annexes to Council Directives 86/362/EEC, 86/363/EEC and 90/642/EEC on the fixing of maximum levels for pesticide residues in and on cereals, foodstuffs of animal origin and certain products of plant origin, including fruit and vegetables respectively(3) is to be incorporated into the Agreement.

(4) Commission Directive 2001/62/EC of 9 August 2001 amending Directive 90/128/EEC relating to plastic materials and articles intended to come into contact with foodstuffs(4) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter XII of Annex II to the Agreement shall be amended as follows:

1. the following indents shall be added in points 38 (Council Directive 86/362/EEC) and 54 (Council Directive 90/642/EEC): "- 32001 L 0048: Commission Directive 2001/48/EC of 28 June 2001 (OJ L 180, 3.7.2001, p. 26),

- 32001 L 0057: Commission Directive 2001/57/EC of 25 July 2001 (OJ L 208, 1.8.2001, p. 36).";

2. the following indent shall be added in point 39 (Council Directive 86/363/EEC): "- 32001 L 0057: Commission Directive 2001/57/EC of 25 July 2001 (OJ L 208, 1.8.2001, p. 36).";

3. the following indent shall be added in point 52 (Commission Directive 90/128/EEC): "- 32001 L 0062: Commission Directive 2001/62/EC of 9 August 2001 (OJ L 221, 17.8.2001, p. 18)."

Article 2

The texts of Directives 2001/48/EC, 2001/57/EC and 2001/62/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 3

This Decision shall enter into force on 1 June 2002, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(5).

Article 4

This Decision shall be published in the EEA section of, and in the EEA Supplement to, the Official Journal of the European Communities.
