amending Annex XX (Environment) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex XX to the Agreement was amended by Decision of the EEA Joint Committee No 9/2002 of 1 February 2002(1).

(2) Commission Decision 98/368/EC of 18 May 1998 adapting, pursuant to Article 42(3), Annexes II and III to Council Regulation (EEC) No 259/93 on the supervision and control of shipments of waste within, into and out of the European Community(2) is to be incorporated into the Agreement.

(3) Commission Regulation (EC) No 2408/98 of 6 November 1998 amending Annex V to Council Regulation (EEC) No 259/93 on the supervision and control of shipments of waste within, into and out of the European Community(3) is to be incorporated into the Agreement.

(4) Commission Decision 1999/816/EC of 24 November 1999 adapting, pursuant to Articles 16(1) and 42(3), Annexes II, III, IV and V to Council Regulation (EEC) No 259/93 on the supervision and control of shipments of waste within, into and out of the European Community(4) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

The following indents shall be added in point 32c (Council Regulation (EEC) No 259/93) of Annex XX to the Agreement:

"- 398 D 0368: Commission Decision 98/368/EC of 18 May 1998 (OJ L 165, 10.6.1998, p. 20).

- 398 R 2408: Commission Regulation (EC) No 2408/98 of 6 November 1998 (OJ L 298, 7.11.1998, p. 19).

- 399 D 0816: Commission Decision 1999/816/EC of 24 November 1999 (OJ L 316, 10.12.1999, p. 45)."

Article 2

The text of Decisions 98/368/EC and 1999/816/EC and Regulation (EC) No 2408/98 in the Icelandic and Norwegian languages, to be published in the EEA Supplement of the Official Journal of the European Communities, shall be authentic.

Article 3

This Decision shall enter into force on 20 April 2002, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(5).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Communities.
