amending Annex IX (Financial services) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular 98 thereof,

Whereas:

(1) Annex IX to the Agreement was amended by Decision of the EEA Joint Committee No 73/2001 of 19 June 2001(1).

(2) Directive 2001/34/EC of the European Parliament and of the Council of 28 May 2001 on the admission of securities to official stock exchange listing and on information to be published on those securities(2) consolidates several acts currently incorporated in Annex IX to the Agreement.

(3) Directive 2001/34/EC is to be incorporated into the Agreement.

(4) Directive 2001/34/EC repeals several acts presently incorporated in the Agreement, including acts with EEA adaptations.

(5) The EEA adaptations to the acts repealed by Directive 2001/34/EC are to be maintained, in so far as they do not contain transitional provisions having become devoid of purpose,

HAS DECIDED AS FOLLOWS:

Article 1

Annex IX to the Agreement shall be amended as follows:

1. The text of point 24 (Council Directive 79/279/EEC) shall be replaced by the following:

"32001 L 0034: Directive 2001/34/EC of the European Parliament and of the Council of 28 May 2001 on the admission of securities to official stock exchange listing and on information to be published on those securities (OJ L 184, 6.7.2001, p. 1).

The provisions of the Directive shall, for the purposes of the present Agreement, be read with the following adaptations:

(a) Article 41 of the Directive shall not apply;

(b) with regard to the EFTA States, the dates referred to in Article 90 of the Directive shall be the following:

Iceland: 1 January 1994,

Liechtenstein: 1 January 1997,

Norway: 1 January 1994."

2. The text of point 25 (Council Directive 80/390/EEC), point 26 (Council Directive 82/121/EC) and point 27 (Council Directive 88/627/EEC) shall be deleted.

Article 2

The text of Directive 2001/34/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 3

This Decision shall enter into force on 20 April 2002, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(3).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Communities.
