amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 11/2002 of 1 March 2002(1).

(2) Commission Directive 96/5/EC of 16 February 1996 on processed cereal-based foods and baby foods for infants and young children(2) is to be incorporated into the Agreement.

(3) Commission Directive 98/36/EC of 2 June 1998 amending Directive 96/5/EC on processed cereal-based foods and baby foods for infants and young children(3) is to be incorporated into the Agreement.

(4) Commission Directive 1999/39/EC of 6 May 1999 amending Directive 96/5/EC on processed cereal-based foods and baby foods for infants and young children(4) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

The following point shall be inserted after point 54zk (Commission Directive 2001/61/EC) in Chapter XII of Annex II to the Agreement:

"54zl. 396 L 0005: Commission Directive 96/5/EC of 16 February 1996 on processed cereal-based foods and baby foods for infants and young children (OJ L 49, 28.2.1996, p. 17), as amended by:

- 398 L 0036: Commission Directive 98/36/EC of 2 June 1998 (OJ L 167, 12.6.1998, p. 23),

- 399 L 0039: Commission Directive 1999/39/EC of 6 May 1999 (OJ L 124, 18.5.1999, p. 8)."

Article 2

The texts of Directives 96/5/EC, 98/36/EC and 1999/39/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 3

This Decision shall enter into force on 20 April 2002, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(5).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Communities.
