amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 11/2002 of 1 March 2002(1).

(2) Commission Directive 2001/50/EC of 3 July 2001 amending Directive 95/45/EC laying down specific purity criteria concerning colours for use in foodstuffs(2), as corrected by OJ L 217, 11.8.2001, p. 18, is to be incorporated into the Agreement.

(3) Commission Directive 2001/52/EC of 3 July 2001 amending Directive 95/31/EC laying down specific criteria of purity concerning sweeteners for use in foodstuffs(3) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

The following indent shall be added in point 46a (Commission Directive 95/31/EC) in Chapter XII of Annex II to the Agreement:

"- 32001 L 0052: Commission Directive 2001/52/EC of 3 July 2001 (OJ L 190, 12.7.2001, p. 18)."

Article 2

The following indent shall be added in point 46b (Commission Directive 95/45/EC) in Chapter XII of Annex II to the Agreement:

"- 32001 L 0050: Commission Directive 2001/50/EC of 3 July 2001 (OJ L 190, 12.7.2001, p. 14), as corrected by OJ L 217, 11.8.2001, p. 18."

Article 3

The texts of Directives 2001/50/EC, as corrected by OJ L 217, 11.8.2001, p. 18, and 2001/52/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 4

This Decision shall enter into force on 20 April 2002, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(4).

Article 5

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Communities.
