amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 9/96 of 26 March 1996(1).

(2) Directive 2000/14/EC of the European Parliament and of the Council of 8 May 2000 on the approximation of the laws of the Member States relating to the noise emission in the environment by equipment for use outdoors(2) is to be incorporated into the Agreement.

(3) Directive 2000/14/EC repeals, with effect from 3 January 2002, Council Directives 79/113/EEC(3), 84/532/EEC(4), 84/533/EEC(5), 84/534/EEC(6), 84/535/EEC(7), 84/536/EEC(8), 84/537/EEC(9), 84/538/EEC(10) and 86/662/EEC(11), which are incorporated in the Agreement and which are consequently to be repealed under the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Annex II to the Agreement shall be amended as follows:

1. The following point shall be inserted after point 10 (Council Directive 86/662/EEC) in Chapter VI:

"10a. 32000 L 0014: Directive 2000/14/EC of the European Parliament and of the Council of 8 May 2000 on the approximation of the laws of the Member States relating to the noise emission in the environment by equipment for use outdoors (OJ L 162, 3.7.2000, p. 1)."

2. The text of points 1 (Council Directive 79/113/EEC), 2 (Council Directive 84/532/EEC), 3 (Council Directive 84/533/EEC), 4 (Council Directive 84/534/EEC), 5 (Council Directive 84/535/EEC), 6 (Council Directive 84/536/EEC), 7 (Council Directive 84/537/EEC) and 10 (Council Directive 86/662/EEC) in Chapter VI shall be deleted.

3. The text of point 1 (Council Directive 84/538/EEC) in Chapter VII shall be deleted.

Article 2

The text of Directive 2000/14/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 3

This Decision shall enter into force on 20 April 2002, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(12).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Communities.
