amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 133/2001 of 9 November 2001(1).

(2) Commission Directive 2001/31/EC of 8 May 2001 adapting to technical progress Council Directive 70/387/EEC relating to the doors of motor vehicles and their trailers(2) is to be incorporated into the Agreement.

(3) Directive 2001/43/EC of the European Parliament and of the Council of 27 June 2001 amending Council Directive 92/23/EEC relating to tyres for motor vehicles and their trailers and to their fitting(3) is to be incorporated into the Agreement.

(4) Whereas the adaptations to Directive 92/23/EEC of 31 March 1992 relating to tyres for motor vehicles and their trailers and to their fitting (OJ L 129, 14.5.1992, p. 95) made by Chapter XI of Annex I to the Act concerning the conditions of accession of the Republic of Austria, the Republic of Finland and the Kingdom of Sweden and the adjustments of the Treaties on which the European Union is founded(4) are to be incorporated into the Agreement.

(5) The adaptations in the Agreement to Council Directive 92/23/EEC need to be adjusted following the accession of Austria, Finland and Sweden to the European Union,

HAS DECIDED AS FOLLOWS:

Article 1

The following indent shall be added in point 7 (Council Directive 70/387/EEC) in Chapter I of Annex II to the Agreement:

"- 32001 L 0031: Commission Directive 2001/31/EC of 8 May 2001 (OJ L 130, 12.5.2001, p. 33)."

Article 2

Point 45d (Council Directive 92/23/EEC) in Chapter I of Annex II to the Agreement shall be amended as follows:

1. The following shall be added:

", as amended by:

- 1 94 N: Act concerning the conditions of accession of the Republic of Austria, the Republic of Finland and the Kingdom of Sweden and the adjustments of the Treaties on which the European Union is founded (OJ C 241, 29.8.1994, p. 21 as adjusted by OJ L 1, 1.1.1995, p. 1),

- 32001 L 0043: Directive 2001/43/EC of the European Parliament and of the Council of 27 June 2001 (OJ L 211, 4.8.2001, p. 25)."

2. In the adaptation text, the words "12 for Austria", "17 for Finland" and "5 for Sweden" shall be deleted.

Article 3

The texts of Directives 2001/31/EC and 2001/43/EC and of the adaptations to Directive 92/23/EEC made by Chapter XI of Annex I to the Act concerning the conditions of accession of the Republic of Austria, the Republic of Finland and the Kingdom of Sweden and the adjustments of the Treaties on which the European Union is founded in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 4

This Decision shall enter into force on 20 April 2002, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(5).

Article 5

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Communities.
