amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as adjusted by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex II to the Agreement was amended by Decision No 78/2000 of the EEA Joint Committee of 2 October 2000(1).

(2) Commission Directive 2000/21/EC of 25 April 2000 concerning the list of Community legislation referred to in the fifth indent of Article 13(1) of Council Directive 67/548/EEC(2) is to be incorporated into the Agreement.

(3) Directive 2000/21/EC repeals Commission Directive 93/90/EEC of 29 October 1993 concerning the list of substances referred to in Article 13(1) (fifth indent) of Council Directive 67/548/EEC(3), which is incorporated into the Agreement and which is consequently to be repealed under the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Point 1 (Council Directive 67/548/EEC) in Chapter XV of Annex II to the Agreement shall be amended as follows:

1. The following indent shall be added:

"- 32000 L 0021: Commission Directive 2000/21/EC of 25 April 2000 (OJ L 103, 28.4.2000, p. 70)."

2. The 15th indent (Commission Directive 93/90/EEC of 29 October 1993) shall be deleted.

Article 2

The texts of Directive 2000/21/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 3

This Decision shall enter into force on 1 December 2000, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(4).

Article 4

This Decision shall be published in the EEA section of, and in the EEA Supplement to, the Official Journal of the European Communities.
