of 10 November 2000

amending Annex XVIII (health and safety at work, labour law, and equal treatment for men and women) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as adjusted by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex XVIII to the Agreement was amended by Decision No 97/1999 of the EEA Joint Committee of 16 July 1999(1).

(2) Council Directive 1999/38/EC of 29 April 1999 amending for the second time Directive 90/394/EEC on the protection of workers from the risks related to exposure to carcinogens at work and extending it to mutagens(2), is to be incorporated into the Agreement.

(3) Directive 1999/38/EC repeals, with effect from 29 April 2003, Directive 78/610/EEC of 29 June 1978 on the approximation of the laws, regulations and administrative provisions of the Member States on the protection of health of workers exposed to vinyl chloride monomer, which is incorporated in the Agreement and which is consequently to be repealed under the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

The following indent shall be added in point 14 (Council Directive 90/394/EEC) of Annex XVIII to the Agreement:

"- 399 L 0038: Council Directive 1999/38/EC of 29 April 1999 (OJ L 138, 1.6.1999, p. 66), as corrected by OJ L 37, 12.2.2000, p. 35."

Article 2

The text of point 2 (Council Directive 78/610/EEC) of Annex XVIII to the Agreement shall be deleted with effect from 29 April 2003.

Article 3

The texts of Directive 1999/38/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 4

This Decision shall enter into force on 11 November 2000, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(3).

Article 5

This Decision shall be published in the EEA section of, and in the EEA Supplement to, the Official Journal of the European Communities.
