amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 64/2001 of 19 June 2001(1).

(2) Directive 2000/13/EC of the European Parliament and of the Council of 20 March 2000 on the approximation of the laws of the Member States relating to the labelling, presentation and advertising of foodstuffs(2), as corrected by OJ L 124, 25.5.2000, p. 66, is to be incorporated into the Agreement.

(3) Directive 2000/13/EC of the European Parliament and of the Council repeals Council Directive 79/112/EEC of 18 December 1978 on the approximation of the laws of the Member States relating to the labelling, presentation and advertising of foodstuffs(3) which is incorporated into the Agreement and which is consequently to be repealed under the Agreement.

(4) Commission Directives 94/54/EC(4), 1999/10/EC(5), Council Directive 96/21/EC(6) and Commission Regulation (EC) No 330/1999(7) which are already incorporated as acts amending Directive 79/112/EEC, should be moved to other points in Chapter XII of Annex II,

HAS DECIDED AS FOLLOWS:

Article 1

Point 18 (Council Directive 79/112/EEC) in Chapter XII of Annex II to the Agreement shall be amended as follows:

1. The text before the adaptation shall be replaced by the following: "32000 L 0013: Directive 2000/13/EC of the European Parliament and of the Council of 20 March 2000 on the approximation of the laws of the Member States relating to the labelling, presentation and advertising of foodstuffs (OJ L 109, 6.5.2000, p. 29), as corrected by OJ L 124, 25.5.2000, p. 66."

2. The text of adaptation (a) shall be replaced by the following: "- in Icelandic 'geislað' or 'meðhöndlað með jónandi geislun',

- in Norwegian 'bestrålt' or 'behandlet med ioniserende stråling'."

3. In adaptation (b), "Article 9(6)" shall be replaced by "Article 9(5)".

4. In adaptation (c), "Article 9a.2" shall be replaced by "Article 10(2)", whereas the first and last indent giving the entries for Finland and Sweden, respectively, shall be deleted.

5. In adaptation (d), "Article 10a" shall be replaced by "Article 12".

Article 2

The following indent shall be inserted in point 54b (Council Regulation (EEC) No 2092/91) in Chapter XII of Annex II to the Agreement: "- 399 R 0330: Commission Regulation (EC) No 330/1999 of 12 February 1999 (OJ L 40, 13.2.1999, p. 23)."

Article 3

The following points shall be inserted after point 54zb (European Parliament and Council Directive 95/2/EC) in Chapter XII of Annex II to the Agreement: "54zc. 394 L 0054: Commission Directive 94/54/EC of 18 November 1994 concerning the compulsory indication on the labelling of certain foodstuffs of particulars other than those provided for in Council Directive 79/112/EEC (OJ L 300, 23.11.1994, p. 14), as amended by:

- 396 L 0021: Council Directive 96/21/EC of 29 March 1996 (OJ L 88, 5.4.1996, p. 5).

54zd. 399 L 0010: Commission Directive 1999/10/EC of 8 March 1999 providing for derogations from the provisions of Article 7 of Council Directive 79/112/EEC as regards the labelling of foodstuffs (OJ L 69, 16.3.1999, p. 22)."

Article 4

The texts of Directive 2000/13/EC of the European Parliament and of the Council, as corrected by OJ L 124, 25.5.2000, p. 66, in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 5

This Decision shall enter into force on 29 September 2001, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(8).

Article 6

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Communities.
