amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex I to the Agreement was amended by Decision No 189/1999 of the EEA Joint Committee of 17 December 1999(1).

(2) Commission Decision 1999/399/EC of 2 June 1999 amending Decisions 93/24/EEC and 93/244/EEC and concerning additional guarantees relating to Aujeszky's disease for pigs destined for the territory of Luxembourg(2) is to be incorporated into the Agreement.

(3) Commission Decision 1999/579/EC of 28 July 1999 amending Decisions 93/42/EEC and 95/109/EC concerning additional guarantees relating to infectious bovine rhinotracheitis for bovines destined for certain parts of the territory of the Community, and repealing Decision 97/250/EC(3) is to be incorporated into the Agreement.

(4) Commission Decision 2000/159/EC of 8 February 2000 on the provisional approval of residue plans of third countries according to Council Directive 96/23/EC(4) is to be incorporated into the Agreement.

(5) This Decision is not to apply to Iceland and Liechtenstein,

HAS DECIDED AS FOLLOWS:

Article 1

The following indent shall be added in points 9 (Commission Decision 93/24/EEC) and 19 (Commission Decision 93/244/EEC) in Part 4.2 of Chapter I of Annex I to the Agreement:

"- 399 D 0399: Commission Decision 1999/399/EC of 2 June 1999 (OJ L 150, 17.6.1999, p. 32)."

Article 2

The following indent shall be added in points 12 (Commission Decision 93/42/EEC) and 27 (Commission Decision 95/109/EC) in Part 4.2 of Chapter I of Annex I to the Agreement:

"- 399 D 0579: Commission Decision 1999/579/EC of 28 July 1999 (OJ L 219, 19.8.1999, p. 53)."

Article 3

The text of point 42 (Commission Decision 97/250/EC) in Part 4.2 under the heading "Acts of which the EFTA States and the EFTA surveillance authority shall take due account" shall be deleted.

Article 4

The following point shall be inserted after point 15 (Council Decision 1999/534/EC) in Part 7.2 of Chapter I of Annex I to the Agreement:

"16. 32000 D 0159: Commission Decision 2000/159/EC of 8 February 2000 on the provisional approval of residue plans of third countries according to Council Directive 96/23/EC (OJ L 51, 24.2.2000, p. 30)."

Article 5

The texts of Commission Decisions 1999/399/EC, 1999/579/EC and 2000/159/EC in the Norwegian language, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 6

This Decision shall enter into force on 31 March 2001, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(5).

Article 7

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Communities.
