No 28/2001

of 30 March 2001

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex I to the Agreement was amended by Decision of the EEA Joint Committee No 189/1999 of 17 December 1999(1).

(2) Council Decision 1999/534/EC of 19 July 1999 on measures applying to the processing of certain animal waste to protect against transmissible spongiform encephalopathies and amending Commission Decision 97/735/EC(2), as corrected by OJ L 237, 8.9.1999, p. 10, is to be incorporated into the Agreement.

(3) Directive 1999/72/EC of the European Parliament and of the Council of 29 July 1999 amending Directive 92/117/EEC of the Council concerning measures for protection against specified zoonoses and specific zoonotic agents in animals and products of animal origin in order to prevent outbreaks of food-borne infections and intoxications(3) is to be incorporated into the Agreement.

(4) This Decision is not to apply to Iceland and Liechtenstein,

HAS DECIDED AS FOLLOWS:

Article 1

The following shall be added in point 67 (Commission Decision 97/735/EC) in Part 1.2 of Chapter I of Annex I to the Agreement:

"as amended by:

- 399 D 0534: Council Decision 1999/534/EC of 19 July 1999 (OJ L 204, 4.8.1999, p. 37), as corrected by OJ L 237, 8.9.1999, p. 10."

Article 2

The following indent shall be added in point 8 (Council Directive 92/117/EEC) in Part 7.1 of Chapter I of Annex I to the Agreement:

"- 399 L 0072: Directive 1999/72/EC of the European Parliament and of the Council of 29 July 1999 (OJ L 210, 10.8.1999, p. 12)."

Article 3

The following point shall be inserted after point 9 (Council Directive 90/667/EEC) in Part 7.1 of Chapter I of Annex I to the Agreement:

"9a. 399 D 0534: Council Decision 1999/534/EC of 19 July 1999 on measures applying to the processing of certain animal waste to protect against transmissible spongiform encephalopathies and amending Commission Decision 97/735/EC (OJ L 204, 4.8.1999, p. 37), as corrected by OJ L 237, 8.9.1999, p. 10."

Article 4

The texts of Council Decision 1999/534/EC, as corrected by OJ L 237, 8.9.1999, p. 10, and Directive 1999/72/EC of the European Parliament and of the Council in the Norwegian language, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 5

This Decision shall enter into force on 31 March 2001, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(4).

Article 6

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Communities.
