amending Annex XVIII (Health and safety at work, labour law, and equal treatment for men and women) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex XVIII to the Agreement was amended by Decision No 97/2000 of the EEA Joint Committee of 27 October 2000(1).

(2) Commission Directive 2000/39/EC of 8 June 2000 establishing a first list of indicative occupational exposure limit values in implementation of Council Directive 98/24/EC on the protection of the health and safety of workers from the risks related to chemical agents at work(2) is to be incorporated into the Agreement.

(3) Directive 2000/39/EC repeals, with effect from 31 December 2001, Commission Directive 96/94/EC of 18 December 1996 establishing a second list of indicative limit values in implementation of Council Directive 80/1107/EEC on the protection of workers from the risks related to exposure to chemical, physical and biological agents at work(3), which is incorporated in the Agreement and which is consequently to be repealed under the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

The following point shall be inserted after point 16i (Directive 1999/92/EC of the European Parliament and of the Council) in Annex XVIII to the Agreement: "16j. 32000 L 0039: Commission Directive 2000/39/EC of 8 June 2000 establishing a first list of indicative occupational exposure limit values in implementation of Council Directive 98/24/EC on the protection of the health and safety of workers from the risks related to chemical agents at work (OJ L 142, 16.6.2000, p. 47)."

Article 2

The text of point 3b (Commission Directive 96/94/EC) of Annex XVIII to the Agreement shall be deleted with effect from 31 December 2001.

Article 3

The texts of Directive 2000/39/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 4

This Decision shall enter into force on 24 February 2001, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(4).

Article 5

This Decision shall be published in the EEA section of, and in the EEA Supplement to, the Official Journal of the European Communities.
