amending Annex XIII (Transport) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as adjusted by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Articles 98 and 101 thereof,

Whereas:

(1) Annex XIII to the Agreement was amended by Decision No 148/1999 of the EEA Joint Committee of 5 November 1999(1).

(2) Council Directive 96/67/EC of 15 October 1996 on access to the groundhandling market at Community airports(2) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

In Annex XIII to the Agreement the following shall be inserted after point 64b (Council Regulation (EEC) No 95/93):

"64c. 396 L 0067: Council Directive 96/67/EC of 15 October 1996 on access to the groundhandling market at Community airports (OJ L 272, 25.10.1996, p. 36).

The provisions of the Directive shall, for the purposes of the present Agreement, be read with the following adaptations:

(a) in Articles 6, 9, 11 and 12, 'Commission' shall read 'EFTA Surveillance Authority' as regards the EFTA States;

(b) Article 20(2) shall not apply."

Article 2

The texts of Directive 96/67/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 3

This Decision shall enter into force on 2 December 2000, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(3).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Communities.
