AGREEMENT

in the form of an Exchange of Letters between the European Economic Community and the Swiss Confederation on trade arrangements for soups, sauces and condiments

Letter No 1

Sir,

I have the honour to refer to the negotiations which have been conducted between the Swiss Confederation and the European Economic Community concerning the arrangements applicable to reciprocal trade in soups, sauces and condiments.

In this connection I hereby confirm that the Swiss authorities, having abolished with effect from 1 July 1977 customs duties on products not containing tomato falling within headings 2104.20 (sauces; condiments and mixed seasonings) and 2105.10 (soups) of the Swiss Customs Tariff, will renounce the right to levy customs duty on the products in the same headings containing tomato.

At the same time the Community will abolish the customs duties which it levies on the products in subheadings 21.04 B and C (sauces containing tomato and other sauces) and 21.05 A (soups with or without tomato) of the Common Customs Tariff. I hereby propose that, subject to the parliamentary approval required in my country, these new arrangements should enter into force on 1 January 1986.

Tables I and II of Protocol No 2 to the Agreement between the Swiss Confederation and the European Economic Community of 22 July 1972 will be amended accordingly. The amendments appear in the Annex to this letter.

I should be obliged if you would confirm the agreement of the Community to the foregoing.

Letter No 2

Sir,

In your letter of today's date you inform me as follows:

'I have the honour to refer to the negotiations which have been conducted between the Swiss Confederation and the European Economic Community concerning the arrangements applicable to reciprocal trade in soups, sauces and condiments.

In this connection I hereby confirm that the Swiss authorities, having abolished with effect from 1 July 1977 customs duties on products not containing tomato falling within headings 2104.20 (sauces; condiments and mixed seasonings) and 2105.10 (soups) of the Swiss Customs Tariff, will renounce the right to levy customs duty on the products in the same headings containing tomato.

At the same time the Community will abolish the customs duties which it levies on the products in subheadings 21.04 B and C (sauces containing tomato and other sauces) and 21.05 A (soups with or without tomato) of the Common Customs Tariff. I hereby propose that, subject to the parliamentary approval required in my country, these new arrangements should enter into force on 1 January 1986.

Tables I and II of Protocol No 2 to the Agreement between the Swiss Confederation and the European Economic Community of 22 July 1972 will be amended accordingly. The amendments appear in the Annex to this letter.

I should be obliged if you would confirm the agreement of the Community to the foregoing.'
